Ukraine war crimes trials a step closer after Red Cross assessment

The Red Cross has made a confidential legal assessment that Ukraine is officially in a war, Western diplomats and officials say, opening the door to possible war crimes prosecutions, including over the downing of Malaysia Airlines MH-17.

"Clearly it's an international conflict and therefore this is most probably a war crime," one Western diplomat in Geneva told Reuters.

The International Committee of the Red Cross (ICRC) is the guardian of the Geneva Conventions setting down the rules of war, and as such is considered a reference in the United Nations deciding when violence has evolved into an armed conflict.

"Within the U.N. system, it's the ICRC that makes that determination. They are the gate keepers of international humanitarian law," said one U.N. source.

The ICRC has not made any public statement - seeking not to offend either Ukraine or Russia by calling it a civil war or a case of foreign aggression - but it has done so privately and informed the parties to the conflict, sources told Reuters.

"The qualification has been shared bilaterally and confidentially," ICRC spokeswoman Anastasia Isyuk told Reuters on Friday. "We do not discuss it publicly."

This is a BIG deal...

This makes BOTH sides accountable for war crimes, especially against civilians, as well as prisoners of war, and finally puts Kiev in the position of having to admit they are fighting a civil war.

That means Kiev is also now respomsible for the actions of the independent militias, such as the Right Sector units, and Kolomoisky's groups.

Does this mean that the Thugs of Donetsk might feel compelled to turn over to the Dutch and OSCE the rest of the bodies they are holding hostage and return the fuselage of the MH17 they took to the shootdown site???

Kiev is not fighting a civil war, they are fighting a proxy war with Russia.

A civil war that involves another nation stirring up the rebels and providing them with arms and troops? That doesn’t sound like a civil war to me.

So if La Raza and Aztlan terrorists began to seize towns and territory in Arizona and Texas and fight the National Guard and Border Patrol bringing in armaments from Mexico that would be a "civil war" too???

Its a civil war

All of the polls, both by international organizations and national in Ukraine, as well as the official election that took place in most of the East and South, that the separatists only enjoy a minority of support. More than half of the dead have been Russkies from Russia.

It is a undeclared war with Russia.

The international red cross and red crescent is the same group that said enhanced CIA interrogation techniques were “torture.” They’re just another commie peacenik front group.

Russian nationals form the military and political leadership of the Russian separatist/terrorist organization. Russian men and equipment are crossing the border into Ukraine daily. This is not a civil war, but a Ukrainian-Russian War

That's funny, Russia funds groups that terrorize, kidnap and kill people in Ukraine, but you're here to remind what Ukraine is responsible for.

Yes, it’s transnational unlawful war by a nuclear power. Just about the worst case scenario. Yugoslavia x 10. Over a hundred thousand where killed there and this looks to be a much bigger war than that.

Will be there first war crimes trials where most the evidence comes from cell phone videos and pics.... public hanging of Putin and his underlings while the cell phones record the justice against these psychopaths.

Now what do we do with the quisling traitors here in America, who do the ground work for Russian war criminals and act against us?
