Court Rules In Favor Of Father Who Spanked Son For Cursing

NEW YORK, NY- When is spanking a crime?

A New York court just ruled in favor of a Long Island Dad who hit his 8-year-old son for cursing.

The court found that spanking was a reasonable use of force.

And other states are okaying it too.

Spanking is at the center of the New York state court case.

The state appellate court dismissed neglect charges against a Long Island father who spanked his 8-year old son for cursing at an adult, saying spanking did not constitute excessive punishment.

Criminal defense lawyer Arthur Aidala says the judge says as long as the punishment of spanking is within reason.

"The judge looks at the overall circumstances. There are so many children who unfortunately don’t have fathers around. Here you have a dad who cares and is trying to teach his boy a lesson, you don’t curse at adults, boom here's a whack," said Aidala.

If you consistently teach your children and occasionally
give them a swat on the diaper, by the time they are our of diapers, the swat is no longer necessary.

We raised 7 and they turned out to be productive members of society who still speak to us.

When I was a kid my parent’s didn’t have to spank me for cursing, they just got a bar of wet soap and washed my mouth out with it. I think I only cursed once and have never cursed since.

We used 1-2-3 magic method. It works well up to a point.

And it only takes a few “3’s for them to get the message. The difference for me was that upon reaching “3” they got a 3 shot spanking not a 5 minute time out. The “time out” deal expired pretty early on and “corporal” made sure they understood the rules.

My hard and fast rule is: no more than three shots to the backside. There were pants up spankings, and pants down spankings, and they know the difference.

Also, I would count at varying speeds to inject a level of uncertainty to assure immediate compliance with the first directive.

My kids are 8 and 6 and I haven’t had to spank them but a few times in their lives. Once to the understood what it meant to get to “3” and, once pants down as what I called “capital” offenses.

Logic and reason take time to educate very small children into, and it should be done, and in the meantime a single
smack can stop something immediately, give the child pause
to think, and leaves room for reasonable discussion when
the child is ready for it.

I sometimes babysit my great-nephews. They are 2 and 4, so let’s just say there are some discipline issues.

One day, after the 3rd time-out, the older one looked at me and said “Don’t you just ever spank kids?!?!”. He was exasperated with this whole “you did this, you sit here, you tell me what you did wrong, you get up”. Major waste of his time.

I told him that only moms and dads and Grampa are allowed to spank. His timeouts have decreased. He knows what to expect, in the behaviour department, from me. And yes, I did spank my kids, but not after a certain age (probably about 4).

You cannot possibly reason with a two year-old, but they do understand a stern “No” with that exclamation point.
