But he finds his gun, but not his phone? That seems sort of silly, doesn’t it?

I sincerely wish that some day you will wake up in the dead of night, lights off and someone apparently making sounds like they are trying to break into your house.

If you had any common sense at all the first thing on your mind would be to PROTECT YOURSELF....NOT MAKE A TELEPHONE CALL! In your case, I doubt that for that requires common sense.

Earlier this year I had someone bang on my door about 2am and the first thing I did was grab the pistol I have beside my bed, walk up to my front door, open it and stick the pistol right up his “snot locker” before asking any questions at all. Then we had a conversation and found out he was a neighbor who needed to report that my handicapped son (who lived 5 blocks away) had fallen down and the police and ambulance services was over at my house and he did not have my telephone number.

If he had continued to try to force his way in, I would have blown him away without any hesitation.

The point of this story is that:

1. When seconds count don’t call the police for they will be there within a matter of minutes while you only have seconds to protect yourself. See what the problem is FIRST and then call the cops. If needed, use lethal force if necessary.

2. ALWAYS arm yourself FIRST and not with a cell or telephone. Time is of the essence!

3. Don’t ever believe that the “justice system” is blind for it is only color blind.

“I would have blown him away without any hesitation.”

And how would you have felt about killing someone who was only trying to summon you because your son was in trouble?

I would also say that “banging on a door” is not the same as trying to force the door open.

I would also say that while you opened the door and showed your weapon you didn’t immediately shoot the guy in the face. Perhaps if the man in the story had done that we wouldn’t even be having this discussion.

I don't have an opinion on this case, but I found the following statement interesting:

"questioned [Wafer's] account, pointing out that he had told the police that his phone is regularly kept in his jeans pocket." From the Times:

It was 5AM, the homeowner probably doesn't wear his jeans to bed. If he is living alone, like many single men he might be less than pristine in his housekeeping. He may not have remembered where those jeans were. In a ball on the floor? In one of the bathrooms? Maybe he decided to put the jeans (sans phone) in the clothes hamper.

Those of us who are married have had our wives respond to the question, "Where are the keys/checkbook/phone?" with "It's in my purse.", having no idea where the purse is.

That said, I'd have to hear a bit more to distinguish this gal from a guy banging on the door of the wrong house at 5AM to go duck hunting, knowing that his pal doesn't wake up easily.

And if you were this guy you would have opened your door, blown your neighbor's head off, and wondered what he wanted to begin with.
