Chris McDaniel to file challenge to Mississippi Senate results

Mississippi state Sen. Chris McDaniel is expected to file a formal legal challenge on Thursday to the June 24 Republican primary runoff that he narrowly lost to incumbent Sen. Thad Cochran, alleging that thousands of votes cast in favor of his opponent were illegal.

On Tuesday, McDaniel said his lawyers have a "rock-solid" case to make, according to the Jackson Clarion-Ledger.

McDaniel's team has argued that thousands of people who voted in the Republican runoff also cast ballots in the Democratic primary earlier in June, which would make their ballots invalid under state law. His team has highlighted affidavits from volunteers flagging thousands of illegal or irregular votes.

Cochran's team has pushed back, saying the race was decided fairly, and with no more irregularities than any other election.

Most legal observers say McDaniel's' case is a long shot. Still, Cochran's margin of victory in the runoff was only 7,667 votes, so the invalidation of several thousand votes, however unlikely, could affect the result.

McDaniel first took his complaints about the runoff election to the Mississippi Republican Party, which promptly volleyed the challenge to the courts, saying it was simply too big an issue for the state party to resolve in a timely manner.

According to the Clarion-Ledger, Mississippi Supreme Court Justice William L. Waller Jr. will appoint a special judge to preside over the case. There is no deadline for the court to reach a decision, but ballots for November's general election bearing either Cochran's or McDaniel's name must be delivered to county clerks by September 10.

This is only about the umpteenth time I's heard or seen this, so what's the hold up? I'm beginning to wonder that if he made it to DC that he would be a lot of hot air and no action like all the rest of the worthless members of congress.

Whatever the final outcome, McDaniel's challenge endured an embarrassing hiccup this week, when observers spotted a curious pair of names on a list of hundreds of allegedly invalid votes circulated by McDaniel's attorney Mitchell H. Tyner on Monday.

Among the hundreds of allegedly fraudulent voters listed on an affidavit bearing Tyner's firm's letterhead were Tyner himself and his wife Sloane. Both were described as having "voted written in margin and on June 24," implying that they voted in the June 3 Democratic primary before crossing over to vote for Cochran in the June 24 GOP runoff.

This is only about the umpteenth time I's heard or seen this, so what's the hold up?

From what I've read in the legal blogosphere, he keeps trying to turn up the 7,000+ invalid votes that he needs to overturn Cochran's margin, but actually has hard evidence of only about 2,500 cross-overs. So he keeps stalling, while talking about thousands more "questionable" votes that reflect possible sloppiness by poll workers but do not involve any provable fraud that will stand up in court.

He’d better NEVER give up.

Today is his last day to go to court, so he's fast approaching "now or never" time. I expect him to file late this afternoon, but I doubt he'll have hard proof of enough invalid votes to set aside Cochran's win.

He had to gather information, with the State Election establishment stonewalling. Then he had to file a charge with the state republican party. And when they, as expected, turned down a hearing, he can now move to the courts.

The way I heard it the elections people were not turning over the records for verification.

Standing in the way Stonewalling is typical of Democrats, but now that Republicans are doing it we should be angry.

This republic doesn’t work well if the vote is in doubt.

This is good news. I always thought the GOP were a bunch of cowardly dolts. Remember how Gregoire stole the election from Rossi (Washington), and the GOP did very little to back him up.

He had to gain access to all the records, find the fraudulent votes that exceeded the margin of victory. Every step of the way his team was hassled and challenged by their own party.

If there is fraud enough to overturn the election, it should be overturned. If that requires that another run off is held, it should be. If it is required that McDaniel replaces Cochran as the candidate, it should be so.

Thad Cochran through his surrogates Rove and the detestable Haley Barbour ran a fraudulent campaign. If it can be proved that ineligible voters voted in the run off, those voters should be prosecuted to the furthest extent of the law. A fraudulent vote is theft against a legitimate vote.

If it is proved that Cochran, Rove and Barbour are complicit in this fraud they should also be prosecuted, convicted and imprisoned as this is an affront to a healthy Constitutional Republic.

Voter fraud is real. It has cost Republicans, particularly Conservatives, their rightful victories. It must be stopped.

There was some delay because the records had to be redacted (the Mississippi Supreme Court ruled that he couldn't see voters' dates of birth and Social Security Numbers), but he did get all the records.
