Court Ruling Could Bring Down BYOD

In what could be a decisive blow to the Bring Your Own Device (BYOD) mega trend, the California Court of Appeal ruled late last week that companies must reimburse employees for work-related use of personal cellphones, as described in the National Law Review.

Specifically, the Court of Appeal in Cochran v. Schwan's Home Service stated:

"We hold that when employees must use their personal cellphones for work-related calls, Labor Code section 2802 requires the employer to reimburse them. Whether the employees have cellphone plans with unlimited minutes or limited minutes, the reimbursement owed is a reasonable percentage of their cellphone bills."

The ruling can open doors to reimbursements for all personal devices, apps and data used partially for work. In one of the great BYOD ironies, CIOs cite the demise of home WiFi reimbursements as evidence that BYOD reimbursements will eventually come to an end, but now home WiFi reimbursements might get a second life in light of this ruling.

This doesn’t affect me,I’m retired,but for some strange reason I found the article fascinating.

I’ll have to alert my kids-—and grand kids.:-)

Instead, our bank got greedy and decided they wanted to save the full $4.6 million dollars and give BYOD users ZERO in a monthly stipend towards their monthly smartphone bills to offset cost.

I was the guy who made that decision. Saves our company a cool 350,000/annum.

Seems like you should be able to put in again for the $5K award, if they are changing the plan to what you suggested.

You can bet I plan on doing just that. Up to and including an email to the CEO of the bank letting him know that his "drive down expenses" program is screwing employees who identify and implement real cost savings to the bank ...

I had a similar experience stateside.

At my last office at the Pentagon before I retired I was one of the two lowest ranking officers. I was a Captain in a LtCol billet. Anyway, they relied on me to do a lion's share of the work because I was the only one there with degrees in Engineering and Physics and they dealt with a lot of technical things of which they knew nothing.

While I usually worked 60 hours per week or more (one week I actually worked 104 hours and lived in the office alone) they would take time off, go golfing, and take leave. I would schedule my leave times four months in advance with their approval but they cancelled every single leave about one week prior using the excuse that they could not live without me.

I was so tired and jaded that when I received my line number for Major I instead put in my retirement paperwork and left at the 20 year point. I never looked back and made them mail my Defense Meritorious Service Medal to my home because I did not want a bunch of two-faced liars to attend my award ceremony.

Nothing. The program was targeted towards employees who had bank owned and bank funded Blackberry devices.

The people who typically had/have blackberry devices in our bank are Senior Management, those who travel alot (and need both voice and email internationally) and critical operational support personnel. As silly as it seems, having a bank owned and funded Blackberry was considered a "privilege" and a "sign" that one was "invaluable" to the bank. That was then.

I work for a company with a presence in all 50 states and many foreign countries. A privileged few get company phones. Most of us are expected to use our personal cell phones for business and never get a penny of reimbursement. I spend $300/month on cell bills. A substantial part of that is caused by the business requirement. I work out of the San Diego office. I can see the bite marks forming on the corporate backside as I write this.
