Isn't that what we've been trying to do for at least the last 40 years? I know I have. If you can figure out how to do it then we wouldn't need to amend the Constitution. So far, though, I ain't seen squat.

Update: Added a Judiciary Reform amendment, it especially changes the way the courts will handle the 5th, 6th, and 8th amendments… and reaffirms the 2nd.

Added a Judiciary Reform amendment, it especially changes the way the courts will handle the 5th, 6th, and 8th AND 14th amendments… and reaffirms the 2nd.

The judicial activism regarding the 14A has given the feds almost unlimited power and has lead to the holocaust of the infanticide of some 70 million unborn and threatens our 1A and 2A rights.

Skewer the judicial wresting of 14A, get it back on its right footing, and the other stuff goes away because the feds have no constitutional right to enforce THEIR WILL on amendments One through Ten.

Good job, Bro. The 14th Amendment is one of the Big Three areas of the Constitution, as I see it, that SCOTUS judicial activism has so mutilated that we are left with an unrestrained federal government with unlimited power.

1) The 14th Amendment "Incorporation Doctrine". Originally intended to forbid state laws segregating former slaves, 14A has been construed by SCOTUS to allow the feds to enforce the first Ten Amendments and interfere with state laws leading to a parade of horribles like banning prayer and Bible study in state schools, 70+ million abortions, interference with state marriage laws, etc.

2) The [Interstate] Commerce Clause (Art I, Sec 8, Cl 3). Originally intended to allow minimal problems regarding commerce between the states, the CC Clause has astonishingly been expanded to give the feds almost unlimited power over intrastate and local economic activities leading to minimum wage laws, individual subsidies, and interference in just about every business enterprise and economic endeavor, the latest, most obvious being the push to socialize healthcare with "Obamacare".

3) The "Necessary and Proper Clause" (Art I, Sec 8, Cl 18). Originally intended to allow executive enforcement and regulation pursuant to legislation within the scope of the Constitution, the N&P Clause has been expanded beyond constitutional grounds and limits to such an extent that a quasi-fourth branch of government has been created: the Administrative State with behemoth bureaucracies like the $1 trillion unconstitutional Dept of Heath and Human Services.
