Boehner, Republicans Blast Surprise Obama-China Climate Deal

House Speaker John Boehner warned that President Barack Obama was waging a "crusade" against affordable energy after the United States and China reached agreement Wednesday on curbing greenhouse gas emissions.

"This announcement is yet another sign that the president intends to double down on his job-crushing policies no matter how devastating the impact for America's heartland and the country as a whole," Boehner said after Obama and his Chinese counterpart Xi Jinping inked a landmark agreement at a summit in Beijing.

"It is the latest example of the president's crusade against affordable, reliable energy that is already hurting jobs and squeezing middle-class families."

Boehner was quickly joined by the Senate Republican leader Mitch McConnell, who said he was "particularly distressed" by the deal, which sees the two global powers achieve breakthrough cooperation in the fight against climate change.

"I read the agreement requires the Chinese to do nothing at all for 16 years while these carbon emission regulations are creating havoc in my state and other states around the country," McConnell told reporters as he met with newly elected Republican senators.

It's good they're stepping right on it. China promised to continue to raise carbon emissions for 16 more years. Obama promised to unilaterally solidify policies that are destroying coal and other energy now. What kind of deal is that?

Isn't this a treaty that needs approval of the US Senate?

Apparently this lunacy is being accomplished through an executive order using the EPA. Close EPA down.

Treaties need 2/3 Senate approval. But Obama and his EPA will just go ahead and do it, unless McConnell and Boehner take some action, like defunding the EPA.

The Chinese must have laughed their butts off as soon as Obama left the room. Only the Chinese could keep a straight face long enough for him to leave.

What a joke of a “deal” and a “leader.”

On the other hand, President Obama probably got EXACTLY what he wanted - a lessening of American leadership and presence in the world.

Does not any of these regs have to have some basis in fact? Can this guy just issue orders to do things to a regulatory body which is empowered to do things under law? Does this rise to the level of a treaty requiring consent by the Senate?
Is this actionable through the courts as a capricious regulation foisted by the jerk on the public? He can do things with the executive branch and force the executive branch to do things by fiat but how does he get away with doing this to the general public??

The Senate’s Role in Treaties

Excerpt:

The Constitution provides that the president “shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two-thirds of the Senators present concur” (Article II, section 2). The Constitution’s framers gave the Senate a share of the treaty power in order to give the president the benefit of the Senate’s advice and counsel, check presidential power, and safeguard the sovereignty of the states by giving each state an equal vote in the treatymaking process. As Alexander Hamilton explained in Federalist no. 75, “the operation of treaties as laws, plead strongly for the participation of the whole or a portion of the legislative body in the office of making them.” The constitutional requirement that the Senate approve a treaty with a two-thirds vote means that successful treaties must gain support that overcomes partisan division. The two-thirds requirement adds to the burdens of the Senate leadership, and may also encourage opponents of a treaty to engage in a variety of dilatory tactics in hopes of obtaining sufficient votes to ensure its defeat.

There’s no agreement that SOB can make with anyone that doesn’t require Senate confirmation to be legal, to be constitutional.

The most meaningless agreement ever announced. The Chinese know it does not have the force of law because the “agreement” like the vaunted “P5+1” negotiation will never be approved by the United States Senate. Obama has already done all he can to implement the Kyoto treaty and the Copenhagen accords despite neither are the law of the United States. His EPA and Interior regulations can be changed or defunded anytime. The Chinese are laughing at this clown.

I may be a little rusty, but --- on order to sign a treaty with another sovereign State, doesn't the Senate have to approve by a 2/3 majority?

What can the Senate do at this point? Pass a law saying the Obama/China agreement is void, unenforceable and without effect5??
