Loretta Lynch Has No Problem With Civil Asset Forfeiture -- And That's A Problem

After the tumultuous Attorney Generalship of Eric Holder, what the country badly needs is a replacement who will uphold the law fairly and guard against injustices perpetrated by the government. President Obama’s nominee to replace him, federal prosecutor Loretta Lynch is questionable in that regard because of her enthusiastic embrace of civil asset forfeiture, which often deprives perfectly innocent people of their property.

In an editorial published November 22, “Loretta Lynch’s Money Pot,” the Wall Street Journal revealed that during her tenure as U.S. attorney for the Eastern District of New York, Ms. Lynch has used civil asset forfeiture in more than 120 cases, raking in some $113 million for federal and local coffers. The trouble with civil asset forfeiture cases is that they frequently inflict severe losses on people who have only the most tenuous connection with a crime – or even no connection at all.

The editorial discloses the facts of the Bi-County Distributors case, overseen by Lynch’s office. Bi-County is a small business run by Jeffrey, Richard, and Mitch Hirsch. Their business deals largely in small amounts of cash and in May 2012, their account held $446,651.11, when it was confiscated entirely by Eastern District prosecutors.

Bi-County sells candy and snack food items to small retailers on Long Island, but, disfavored as such things may be by the Washington elite, that business is entirely legal. There has never been any allegation of any wrongdoing by the company or its owners, but they were under suspicion because of many cash deposits of less than $10,000. Under IRS regulations, banks must report cash deposits of $10,000 or more, but the feds look at substantial deposits of smaller amounts as grounds for suspicion, thinking that the depositor must be trying to avoid detection.

Yep...

they didn’t like our customers’ business model,
but there was no law against it,

so they told the banks that they wouldn’t approve of their future mergers if they kept doing business with them.

Should make her popular with Republican members of the Judicial Committee.

Asset forfeiture got big under Bush 41 and has been amped up over the years by “conservative” state governors, mayors, and legislatures.

As long as the cops get more money for more paramilitary toys, they are all for it.

Occasionally someone with some actual principles objects and says it should only happen with convictions, but they get ignored and the State looting continues.

Yet another reason why the GOPe doesn’t really represent its base.

I read an article stating that when Loretta Lynch started Harvard, she co-founded an African-American sorority. There was only one other girl in this sorority, Sharon Malone. The name rang a bell.

The name of the wife of AG Holder is Sharon Malone, she is the sister of a known civil rights leader Vivien Malone -Jones (one of 2 black students who enrolled in all white University of Alabama).

I checked the age: both were born in 1959 and both went to Harvard at the same time. There were very few African American students in Harvard in 1977-1981, so I am rather certain that Loretta Lynch is an old college friend of Sharon Malone, the wife of the current AG Eric Holder.

Why this connection is important? Holder will be investigated by Congress for totally lawless gun trafficking to Mexican drug cartels in Fast and Furious, IRS scandal, VA scandal, DOJ, NSA, EPA, FEC and other scandals. Most importantly, Holder covered up Obama’s use of a stolen CT Social Security number of Harrison J. Bounel 042-68-4425 and Obama’s use of bogus IDs. It seems that a long time college friend of Holder’s wife was picked up as a gate keeper to continue all of the cover up by Holder and shield Holder and Obama from criminal prosecution.

This sort of theft was successfully sold to low-information voters left and right as a needed tool in the War on Drugs - in fact it was all about getting the money all along.

Yep. Of course, most peopled cheered when these programs got started back in the 80’s because they were only going to be doing it to, you know, those people. And now that eveybody’s a target, suddenly its a problem. Too little, WAY too late.
