Incoming Senate Majority Leader Mitch McConnell, Kentucky Republican, says he has every intention of voting to repeal Obamacare with a new GOP majority in January, but also said people should be realistic about what to expect in the way of repeal with President Obama still in the White House.
We certainly will have a vote on proceeding to a bill to repeal Obamacare. It was a very large issue in the campaign, Mr. McConnell told Roll Call. Were certainly gonna keep our commitment to the American people to make every effort we can to repeal it.
It is a statement to the obvious, however, that Obama of Obamacare is the president of the United States, so I dont want people to have [unrealistic] expectations about what may actually become law with Obama of Obamacare in the White House, he said. The subject of the article you posted is ‘repealing’ ObamaCare. If you’re interested in replacing it, please make it less ‘difficult’ for me and describe just exactly what would meet your criteria and which would satisfy the necessary 13 democrat votes necessary to override the veto.
There is no rationale in criticizing the GOP leadership unless you you can layout a concrete plan to repeal/replace Obamacare.

Regardless what activist justices, Democrats and RINOs in DC evidently want everybody to think about the constitutionality of Obamacare, federal government leaders continue to ignore that the Supreme Court had previously clarified that the states have never delegated to the feds, expressly via the Constitution, the specific power to regulate, tax and spend for intrastate healthcare purposes.
State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress. [emphases added] Gibbons v. Ogden, 1824.
In fact, the Supreme Court has also clarified in general that powers not delegated to the feds by the states via the Constitution, the power to regulate intrastate healthcare in this example, are prohibited to the feds.
From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]. United States v. Butler, 1936.
Please bear in mind that the 10th Amendment is probably one of the best-kept secrets in DC.

McConnell and Boehner will schedule a vote on repeal in the spring. It will pass the House and Senate and sent to the President. He will veto it. The veto will not be overridden. McConnell and Boehner will proclaim, “we tried” and the story is over.
If the shoe were on the other foot, Reid and Pelosi would be using everything from FBI records to pork to swing enough members of the opposition party to override the veto.
Boehner and McConnell will only play hard ball with members of their own party. As a result they are bullies, not leaders.
