Comes now Steven F. Hotze, M.D. ("Hotze"), a citizen of the United States and resident of Texas who is acting pro se on this motion, and respectfully moves, pursuant to 28 U.S.C. § 455, for the recusal of Justices Ruth Bader Ginsburg and Elena Kagan in these consolidated cases, and states the following grounds:

Boiled down, the argument asks them to recuse themselves because they are so obviously gay.

Actually, I believe Ginsburg and Kagan have officiated at same-sex marriages in the District of Columbia, which enacted same-sex marriage through its legislature (the city council). So, those marriages would remain valid however the Court rules.

Not gonna happen. As I understand it’s entirely up to the individual judges to choose whether or not to recuse themselves.

This Writ asks corrupt Judges, who met with Obama
EX PARTE when the case of his LACK OF DOCUMENTATION
was before them, to respect the Law.


Here is the actual picture of the ex parte meeting.

So, as to the Writ. Not gonna happen. There will be no Justice.
The blackrobes have no, zero, zed, Honor or respect
for the Law (or Constitution).

They should recuse themselves on the basis that they cannot be unbiased jurors. But they won’t because liberalism trumps fairness.

Regardless of the merits, this has no chance. Recusal is entirely up to the individual justices. This came up about a decade ago in a case involving Vice President Cheney. The left argued that Justice Scalia should recuse himself from some case (don’t remember which one) because he had gone duck hunting with Cheney. Scalia essentially told them to buzz off, and they had no recourse.

28 U.S.C. § 455(a) mandates that any justice of the United States "shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned." See Pilla v American Bar Ass'n, 542 F.2d 56, 58 (8th Cir. 1976) (explaining that 28 U.S.C. § 455(a) applies to members of the U.S. Supreme Court).

No, certiorari as a procedure doesn’t exist. Plaintiffs don’t enter Writs of Certiorari, they request them.
