In any other case they would have said "allegedly."
Also, that is a ridiculously weak part of the state's case. The so-called DA used a definition of probable cause that is contrary to American law.

He wasn’t wrongly arrested, because he had an illegal knife in his pocket and he may have had a warrant for his arrest. You can’t have a knife that pops out with one hand in Maryland.
However, he may have been mistreated while under arrest.

It is interesting that a major media outlet doesn’t use “allegedly” in a case that hasn’t been adjudicated, when normally they do so even in open and shut cases that are well-witnessed and maybe even on video.
