Board: Ohio judges can't choose marriage type they perform

COLUMBUS, Ohio (AP) — Judges who perform marriages in Ohio can't refuse to marry same-sex couples on personal or moral grounds or because of religious beliefs, according to a state judicial conduct board.

In addition, judges who stop performing all marriages to avoid marrying same-sex couples may be interpreted as biased and could be disqualified from any case where sexual orientation is an issue, according to an opinion by the Ohio Supreme Court's Board of Professional Conduct issued Friday and made public Monday.

The ruling followed a request for guidance from a Toledo judge who refused to perform a same-sex wedding last month.

Municipal Judge C. Allen McConnell said he didn't marry a same-sex couple because of his religious beliefs after the U.S. Supreme Court made gay marriage legal in all 50 states in June.

So you can’t be a faithful Christian and a judge in Ohio anymore. We now have a religious test for the judiciary.

Then the ‘same-sex marriage’ issue should be reexamined at the Supreme Court level. Considering the fact that two of the ‘Supremes’ had conducted ‘same-sex marriages’, they should have been forced to recuse themselves for obvious bias. Then there’s that other woman who seems to have a closeted bias, too. Three Supreme Court ‘Justices’ voted on an issue in which they had extreme bias. No wonder Americans have lost faith in their Judiciary and their Government.

There are two separate systems. One is the democratic religion-neutral government state and the other is the system of churches God designed for His people. If the law says heteros and homos can marry, the judge has to obey the law. However, if a church distinguishes between hetero and homo weddings, they should in observance of their faith.

I would not be offended by a gay wedding performed by the state whereas I am totally offended by a gay wedding performed by a church that purports to represent the teachings of the Bible. The latter is blasphemy. The former is just the death rattle of a godless society that needs a good spanking before Judgement Day arrives so some might repent and be saved.

Can they choose to not perform ANY marriages?

Why does a representative of The State have to be involved in what was throughout nearly all of recorded history a RELIGIOUS ceremony?

1) What is in the Ohio State Constitution?

2) If necessary, the people of Ohio need to create an initiative or proposition that allows refusal for gay marriages.

3) Also if necessary, nullify the federal decisions and/or acts that have unconstitutionally meddled with marriage.

In the county where I live, 3 of the 4 Justices of the Peace have announced they no longer will conduct any marriage ceremonies.

So, from the other end, I assume any judge who has performed same-sex marriages would be interpreted as biased in any case where religion is involved?

Where in the US Constitution does the Federal government have authority over states rights and consequently marriage? All powers not specifically authorized to the Federal Government are Reserved to the states I think it says.

Yes, that is the presumption of the Constitution as confirmed by the Ninth and Tenth Amendments which have been eviscerated by the mostly unconstitutional decisions of SCOTUS over the last 100 years or so.

Among other things, the states need to defend themselves and their citizens by nullifying unconstitutional federal acts and decisions which by definition are acts of tyranny.

At the same time, I hope we can elect a Trump/Cruz ticket. Trump would bash the politically correct culture which needs to be blown up, and Cruz could follow by actually reducing or preferably eliminating the unconstitutional portion of the feds and giving the country back to the states and the people where it belongs.

At the same time, a sound CoC proposed by the CSG could also help.

All of the above to bash the unconstitutional feds and return America back to the people and to freedom.
