KS: Owner reportedly shoots at burglar; Suspect arrested

He said when the burglar started to come toward the owner, he fired a single shot into the ground to stop his advance. The suspect then ran west, got into a pick up with another suspect and took off.

Police later found the get-away vehicle in the Hi-Crest neighborhood. After a short pursuit and foot chase, two men were taken in for questioning and one of whom, Marks, was detained.

All stolen items were returned to the victim. The TPD said they are still investigating.

Warning shot stoped criminal. All property recovered. I would put considerable money on the proposition that the homeowner will not be prosecuted.

I do not recommend "warning shots", but the absolute fear of them is unwarranted.

There are many documented cases where they appear to "work".

In this case, the shotgun was likely loaded with bird shot, so the danger from ricochet was very small. If shot in the air, virtually no danger to others.

There’s a woman, former army vet IIRC, who fired warning shots at her ex-husband and got a lengthy jail sentence. Can’t remember where it happened but it was discussed on FR.

A warning shot means you aren't endangered enough to shoot at all.

In the time it takes to cycle the action the perp can spill your guts. Unless you have a double barrel or auto you have, for a moment, an empty chamber.

I'm not doing warning shots. There are only 8 shots available in my Mossberg 930 SPX.
I'm not wasting even one.

Simply not true. It is not so black and white. I do not recommend warning shots, but it is not as clear as you think.

It can mean “I took extreme measures to avoid killing the attacker.” That does not mean he would not have been justified in killing the attacker.

IF you make the MISTAKE of firing a “warning shot”, NEVER tell the cops it was a “warning shot”!!!

The ONLY think you EVER tell the cops is that “I WAS IN FEAR FOR MY LIFE, and I fired at the attacker.”

I think you are recalling the Marissa Alexander case. It was rather questionable if the shots fired were “warning shots” or an attempt at homicide.

She became a cause celebre of the “black lives matter” crowed who claimed that she was being victimized because she was black. Some good came of it. The Florida mandatory sentencing law was reformed so that people actually firing warning shots would not be railroaded into pleading guilty to avoid 20 years in prison.

Blatantly false from what the article says.

He did not shoot at the burglar. He shot at the ground.

Not only that, it sounds like his aim was pretty good, too, and he hit exactly what he shot at.

As such, it seems reasonable to assume that if he had shot at the burglar, he most likely would have hit the burglar.

Therefore, the headline is wrong and misleading and I think the reporter should apologize to the homeowner for implying the homeowner is a poor shot.

The man does a good deed and then gets insulted? What is the world coming to?
