Obama weighs expanding background checks through executive authority

In response to the latest mass shooting during his presidency, President Obama is seriously considering circumventing Congress with his executive authority and imposing new background-check requirements for buyers who purchase weapons from high-volume gun dealers.

The proposed executive action aims to impose background checks on individuals who buy from dealers who sell a significant number of guns each year. The current federal statute dictates that those who are “engaged in the business” of dealing firearms need to obtain a federal license — and, therefore, conduct background checks — but exempts anyone “who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms.”

White House officials drafted the proposal in late 2013 to apply to those dealers who sell at least 50 guns annually, after Congress had rejected legislation that would have expanded background checks more broadly to private sellers. While the White House Office of Legal Counsel and then-Attorney General Eric H. Holder Jr. initially concluded the regulation was legally defensible, according to several individuals involved in the discussions, some federal lawyers remained concerned that setting an arbitrary numerical threshold could leave the rule vulnerable to a challenge.

None of the proposals would have prevented the shooter from getting the guns he had.

So what else is new? The Constitution hasn’t stopped him from issuing royal edicts for the last 6-1/2 years, why stop now?

The BATF has never issued a number, because it knows a number can be used as an absolute defense.

If they put the number at 50, then everyone will feel free to sell up to 50 without a problem.

Not only that, buy you can sell 50, then your wife can sell 50, and your adult son can sell 50. Since no records have to be kept, to prove a case, the ATF will have to find records of 50 sales in a single year to prosecute.

That is not the purpose. The purpose is to gradually impose more and more gun control law until they incrementally ban the private ownership of firearms.

bogus just to get s talking about it
secondary sellers already do background checks. the mythical gun show loop hole. Private sellers can’t be touched because they are after all private.

What makes you think 0bama, or any politician for that matter, actually cares about the Constitution?

Seriously: we must assume that ALL of them view the Constitution as something to be ignored, circumvented, thwarted, or simply ignored, unless they prove conclusively that they view it otherwise.

Expanding background checks in what way exactly? What other background checks do you suggest or are you just politicizing gun control yet again?

Not on individual sales in state. What should be looked at is everything hidden in the edict. Will they regulate ammo sales? Will they regulate mags and accessories? Will they drive up the prices?
