Mercy Medical Center, a Catholic hospital in Redding, CA., is being sued by the ACLU after it said it would not perform a tubal ligation procedure during a scheduled cesarian section delivery later this month. Catholic doctrine prohibits contraception, including permanent sterilization like a tubal ligation or vasectomy.
In its ongoing dispute with Catholic hospital officials in Redding, the American Civil Liberties Union filed a lawsuit Tuesday against Dignity Health, contending the hospital system is unlawfully denying women's rights to contraception.
The suit is filed on behalf of Physicians for Reproductive Health and a Redding woman, Rebecca Chamorro, who requested a tubal ligation at Mercy Medical Center in Redding during her scheduled cesarean section in late January. Chamorro and her husband, who have two other children, want the procedure as a permanent form of contraception.
"The overarching issue is about women's ability to access basic health care. It's an incredibly common procedure used by a significant number of married women, but it's being denied based on religious doctrine. It’s a real problem,†said Elizabeth Gill, senior staff attorney with the ACLU of Northern California.
A hospital willing to do the procedure is located about 70 miles from Mercy Medical Center.
What are your thoughts? Should a hospital be ordered to ignore its own doctrine?
That’s what I don’t get. Why would you want to force someone to do this. I would want an experienced Dr doing it.
The ACLU used to do quite a lot of good at one time, working for religious freedom. These days, do they ever help out anyone but Muslims, racists, Satanists, or baby killers?

Another "right" I don't see enumerated anywhere in the Constitution. As opposed to the clearly stated right to the free exercise of one's religion.

Well, given the growing anti Jewish sentiments that liberals have I wouldn’t be surprised if the ACLU would sue them.

NO NO NO It is not, this is about Slavery and nothing else.
If you believe you have a “Fundamental” right to the fruits of my labor (healthcare) you are advocating for SLAVERY, nothing less.
This has set-up written all over it.Wouldn’t be surprised if the ACLU couched the woman to make the demand.
I do not know what law schools ACLU lawyers got indoctrinated at, but the states have never amended the Constitution to expressly protect womens right to contraception.
Note that even if the states make 10th Amendment-protected laws which establish such a right, it remains that the 14th Amendment prohibits the states from abridging constitutional rights, 1st Amendment-protected religious freedom in this example.
14th Amendment, Section 1: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States [emphasis added]; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
With out health care providers out there, why should Catholic hospitals be singled out like this.
Is it a law all hardware stores have to sell hammers?
Do all restaurants have to sell steak?
Do all politicians have to have a brain? LOL
I am sure they have an experienced doctor there who could do it. It’s just the hospital’s policy that they won’t do it.
