White House Press Secretary Josh Earnest said Monday that he would not be surprised if those who are opposed to President Barack Obama using his executive authority to enact gun control legislation without congressional approval try to tie it up in court for the remaining 12 months of Obama's presidency.
"But again the kind of arguments that we'll be able to mobilize in a court of law are ones that I am confident will be powerful and persuasive. Ultimately, a judge will have to decide, but we should not be distracted however from the fact that the reason the president is taking these actions is because Congress has utterly failed in their responsibility to do so," said Earnest. ...

Josh: Congress does not and never does have a responsibility to undermine the Constitution any more than the POTUS (who swore an oath to preserve, protect and defend same) has a right to.
What argument could be persuasive for the Executive to unilaterally deprive citizens of the benefit of the Bill of Rights?
Legislation can not be enacted solely by the POTUS, he has no authority for this. It lies in congress.

This press secretary is lying outright and trying to confuse an uneducated public about what is going on.
Once again, the executive branch does not legislate. Congress legislates. It is the separation of powers and one of our basic cornerstones.
Our founding fathers planned to have actions like this "undermined" by Congress.

He has no Constitutionally vested authority to enact any legislation.
That is the job of the Congress, and he may approve, veto, or have his veto overridden by that legislative body.
Any "legislation enacted" by executive fiat is void.

So this guy is whining about an over reach of authority. Thats gall! As others have correctly pointed out an EO isnt legislation. This administration needs a history/law lesson. They unilaterally try to subvert the way govt was intended to work even when they have no support in the legislature, enforcement or electorate. I also strongly suspect theyll find no help from the judiciary either. Seems completely tone deaf to me.

Ol’ joshee boy ought not be surprised. He ought to count on it going to court. But, knowing the lyin’ king and his minions, they’ll push their desires forward court or no court. It’s the old forgiveness permission thing.
The only appropriate congressional response would be impeachment by the House, and conviction by the Senate.
