Ted Cruz, Read This!!

What would happen if Ted Cruz were to file in Federal Court and sue Congress for Equal Protection under the Fourteenth Amendment? In his suit, he must demand that Congress applied the same standard to him that they applied to Obama and McCain in 2008.

Congress found that Obama was eligible with one citizen parent, the mother. Ted Cruz qualifies under that standard. Congress also found the McCain was eligible despite having been born on foreign soil...that standard must also be applied to Cruz if he wins in court.

Let's bypass all the arguments about Vattel, Naturalization Acts, and so forth. Go straight for Equal Protection and force them to treat you the same as the others.

People seem to think that the courts would balk at making Obama ineligible, even though British common law actually declared that even an ineligible monarch, someone ruling illegally, could pass valid laws. The laws would be made in continuity in order to maintain “public order,” though, of course, anything bad would be undone by whoever came next.

I’m saying that because there doesn’t seem to be a lose lose here for the Democrats even if they’re forced to admit that Obama is not eligible.

McCain was born on US soil (the Canal zone) while his US citizen father was serving in the military. Was Cruz born on US soil? Was his father in the military? Was his father a US citizen?

With Obama, the birthers got played. They got led down the path of determining where Obama was born. Birth Certificate, bogus or not, established he was born in the US. The birthers left the argument of "dad's" Kenyan citizenship which was undeniable. Besides that, in the Obama case, just about everyone acknowledged that Obama had to be born on US territory to be a natural born citizen.

So, what's your point. If you're so sure Cruz is eligible, why not wait four years to run for President, and give the courts time to sort it out?

No lawyer here; but Ted needs a favorable ruling from a source that matters.
Otherwise, he is going to get imPalinned w/ lawsuits out the wazoo. That’s what desperado haters do.

What you should really be sick of is knowing “our” side gave Obama a pass, when we know darn well the dems will fight for the issue.

you are naive to think that there’s anything Cruz could do to stop the Alan Grayson idiots of the world, and frankly, I’d be ashamed to let Grayson’s threat (and others from moonbats) impact my thinking.....which they clearly have done to yours.

Very very naive. You are asking Cruz to accept your premise (he rejects it and he’s more up to speed on the Constitution than you are) and then you want him to do so with a phony gesture that won’t do a damned thing.

It is, indeed. Your argument amounts to "once an error is made, the error must be followed forever after."

IOW, if an error of law benefitted one person, then the error must be equally applied to those who come after. Equal protection of the mistake is not equal protection of the law.

Yup. Our side made some noise about Obama. We said it was a big deal.

Now with Cruz being born in a foreign country (definitely not Hawaii), with a father who was not a citizen, and a lot of us are saying, "Oh, it's no big deal. He's our guy. He's Conservative. It's okay this time."

I try not to be a hypocrite -- I say Cruz has a problem, and it's probably worse than Obama's.
