Here's Why the Ted Cruz Birther Story Isn't Going Away
Mother Jones ^ | 1/15/2016 | AJ Vicens

A lawsuit was just filed questioning his eligibility to serve as president. And that's not all.

It's unclear what will come of this complaint, but this isn't the only birther action that Cruz is contending with. Also on Thursday, the Arizona Republic reported that Rep. Kelly Townsend, a Republican state legislator from the Phoenix suburb of Mesa, is "circulating a measure at the Arizona legislature that would call a U.S. constitutional convention to outline what it means to be a natural-born citizen." The paper notes that Townsend hopes to get her Legislature on board before reaching out to other states, since, after all, "it will take 34 states to convene such a meeting, something that hasn't happened since 1787."

This legislative effort--like the lawsuit--appears quixotic. But Trump has ensured this question of his natural-born citizenship status will dog him. As seen in last night's debate, Trump's questioning of Cruz's eligibility has marked a turning point in relations between the two candidates, who have previously refrained from attacking each other throughout the campaign. But, as Trump told CNN's Dana Bash after Thursday's debate, "I guess the bromance is over."

Perhaps Obama issue was brought up late? I do not remember if it was in a primary or not?

“SCOTUS does not issue declaratory judgments. Cruz knows that, and Trump has been sued enough that he should know it.”

McCain had congress verify his right to be President. Cruz can ask Congress. McCain was born in Panama where his father was serving in the military.

Doubtful Cruz birth question will be going anywhere. There seems to be few who will touch it..just as few who were interested in the last candidate who attempted to travel by the new rules. It is something we should speak of, and understand, but who are we to call it...after all we are only the serfs and have no voice or standing in our judiciary system which (supposedly) was formed for US and our grievances. NBC and anchor babies need smart talk, solutions, definitions, and answers....plain ENGLISH w/no lawyereze please. When speaking their own language attorneys make up their rules as they go along only due to the fact that common man does not grasp their meaning.

FReepers tripping because we always do a critical autopsy on every news story. In politics these things are said and written for votes. Even Trump does not care about details. He only knows voters will react with their gut and heart.

That’s funny. Trumpbots despise congress, but want it to resolve an issue that needs no resolution.

Face it, if Cruz gets this settled to the satisfaction of what Trumpbots are saying today, they will move the goal posts. This isn’t about Cruz, it is about taking out anyone that might hurt widdle baby Donald and his bully ways.

It’s a ridiculous nonissue, but Trump, the liberal media, and the Republican Establishment all want to keep it alive. That way,. we won’t talk about real issues.

I believe you. We have also to look at Zer0 (I love calling him Zer0 because that points to his worthlessness). He is also not a natural born citizen because his father, if that’s the name on the birth certificate, was a British subject:

When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.’s children:

British Nationality Act of 1948 (Part II, Section 5): Subject to the provisions of this section, a person born after the commencement of this Act shall be a citizen of the United Kingdom and Colonies by descent if his father is a citizen of the United Kingdom and Colonies at the time of the birth.

Barack (Barry) lost his dual citizenship (British) when Kenya became an independent nation in Dec. 12, 1963 and received his new dual citizenship as both a Kenyan and a U.S. citizen:

Chapter VI, Section 87 of the Kenyan Constitution specifies that:

1. Every person who, having been born in Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall become a citizen of Kenya on 12th December, 1963 . . .

2. Every person who, having been born outside Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall, if his father becomes, or would but for his death have become, a citizen of Kenya by virtue of subsection (1), become a citizen of Kenya on 12th December, 1963.

Obama’s Kenya recognizes dual citizenship for children, but Kenya’s Constitution specifies that at age 23, Kenyan citizens who possesses citizenship in more than one country automatically lose their Kenyan citizenship unless they formally renounce any non-Kenyan citizenship and swear an oath of allegiance to Kenya.

So, on Obama’s 23 birthday, he lost his Kenyan citizenship. Does that not make Zer0’s status as a natural born citizen complicated? No. For Zer0 to be a natural born citizen, both his mother and dad had to be U.S. citizens and baby Barry had to be born in the United States. He had no eligibility. For some reason, in our haste to get a African American (Zer0 is literally half American and half African) elected, we had a blind eye to his eligibility. This precedent could work for Rafael Edward “Ted” Cruz (I give his birth name to show that both Barack and “Ted” do not go by their birth names). If, in the declaratory judgment about his eligibility, Cruz’s method of pursuit goes towards the idea of precedent he could win even if he is not eligible. That is a legal term that allows one type of action when it has occurred before. Cruz has a legal case here. I hope that that method of attack will cause the State of Hawaii to open up Obama’s true birth certificate to use as evidence towards his status as a citizen. That would be incredible. I hope you stuck with the reading of this to see this last point. I think I am going to put my money on popcorn futures.

There's a good reason it isn't going away: because it shouldn't. It needs to be resolved.

She was a naturalized citizen when Trump was born, and if so, that makes trump a natural born citizen. Article II section 1 clause 5 has only ONE constitutional applicability, and that is eligibility to assume the office of POTUS.

In all other aspects, an NBC is no different than any other class of citizen insofar as duties, rights privileges and obligations. It has only applied to 44 human beings in the history of the US, those who have taken the constitutionally specified oath of office.

I know it was brought up before Christmas 2007 because I raised it with a friend in Oregon when we were visiting our daughter at Christmas. He and his wife looked at me like I was a martian with three eyes (and all of their eyes were rolling).

At least we know who Cruz is and what he’s all about. Obama remains shrouded in mystery, lies and cover up. Sealed records, bogus social security number(s) and the fact that no hospital in Hawaii takes claim of being his birthplace, along with highly questionable birth documents.

I do not think we ever really know them. We think we do. Ryan, Justice Roberts, Tom Coburn. They can be solid then out of nowhere, they vote wrong or get caught up in a scandal. Voters should never fall in love with them. Those who do will be heartbroken.
