Hillary Clinton's criminal defense attorney made a surprise appearance on today's Morning Joe, saying . . . oh, wait: that wasn't Hillary's lawyer--it was Andrea Mitchell. Same difference.
Relying on her sources, Mitchell asserted "I don't think there is the legal culpability here." Andrea first suggested that Hillary lacked "intent." Joe Scarborough pushed back hard, noting that the statute also criminalizes being "reckless" with classified material. Mitchell then switched to a truly absurd argument. Noting that the official State Department system had been hacked, Mitchell said that Hillary's "defense could well be the whole damn system is vulnerable." Shot back Scarborough sarcastically" "good luck with the Justice Department on that."

Anyway, had I “mis-handled” classified documnents even by accident at my job.............minimum of termination max of jail time. And believe me, I’m pretty sure I was on the lower end of the scale when it came to access to classified documents. Didn’t matter. Let it slip by and get caught/discovered+..... BOOOM!

If Hillary Clinton was innocent, don’t you think the only thing we’d see on TV would be Harry Reid and Nancy Pelosi and Obama and Biden screaming their lungs out?

Sycophants are gonna do what sycophants are gonna do. Big Media is jumping the shark when it comes to protecting Hillary!. I DO believe more and more people are awakening to that FACT.
Once State Department employee X, Y and Z cut and paste from a classified document to a unclassified document....they were in violation of law. They were briefed when they got their original access to the classified system, and had to read documentation as they signed onto their system each day. These individuals will eventually end up in a court room and face justice....without much hope.
Hillary and Sid? Their case is different because they didn’t originate the cut-and-paste documents. So they are in a totally different situation. If the Clinton Foundation was keeping these messages (after Hillary and Sid read them) and they were funneled to ‘clients’ of the Foundation later....with money being exchanged for the ‘favors’....then that’s a totally different case, and more worse than the cut-and-paste crowd.
The question is....did Sid and Hillary put the documents into some digital folder, and then sent them onto ‘clients’? If so...was money exchanged? It’d be really helpful for Sid and Hillary if they just went into a folder and never moved or copied ever again. That’s the only way that they avoid jail....other than the AG just skipping this deal.
The only problem I see...it’ll take at least two years for the FBI to build a case here. If they don’t reach the final piece of this until January of 2017, and Hillary has been elected....how do you go into court with the case then?
I guess “intent” is now the new legal standard for handling of classified documents.

If Hillary instructed her servants to remove classification markings (and it appears that she did), that in itself is a crime.

She actually admitted during the segment that she’s not a lawyer but that “I play one on tv”!!
