The House Republicans’ legal challenge to a key ObamaCare subsidy got a boost today from an unlikely source: an IRS official who said agency officials had doubts about the legality of the subsidy payments.

I hope that IRS official has another job lined up.And I hope he/she has the phone number of a good criminal defense lawyer.

There was plainly NO appropriation for these funds.

The person who authorized them was acting outside the scope of appropriation law.

There are both criminal and civil sanctions plus losing ones job at stake.

But here is the kicker, who enforces this law? The same AG who refuses to bring an indictment against Hitlery and the same office that refused to provide any info to Congress regarding the Fast and Furious disaster.

Upshot: We have no controlling legal authority and are now operating as an imperial presidency.

Solution: Lamp posts for all.

The nice thing about ad blockers is that if you really want to see a site that blocks those who block their ads, you can temporarily allow that site - choice can be good.

It worked fine for me. I have an add blocker, but I have allowed IBD java script access. I am running No Script (Firefox plug-in), which allows selective control of java scripts.

There's usually an icon on the menu bar that can be right-clicked to access options.

Probably not a big deal though.

The founders believed that congress held the most power out of the separate branches they created. That conclusion was predicated on a president held in check with the threat of impeachment and removal.

Since congress has failed to assert their authority, we now have monarch or banana republic.

Yes, the founders were careful to structure things in order of precedence. Look at the structure of the Constitution (yes some antiquated document) which has Congress listed in the first article, the Bill of rights has arms listed in the second amendment and albeit today we think the courts are preeminate listed after Article 2, the exeuctive, and almost like a foot note...and so on. Lastly, the whole thing starts off with We The People...it does not start off with the President proclaims or some Judge thinks.

It is clear that if we ever get an Article V Convention we need to remove the law enforcement authority that the Executive Branch has over itself. Maybe put that in the hands of the states.
