The only reason I introduced the concept was to clarify my thoughts, since the courts affix the label "constitutional" to actions that are not constitutional. "Constitutional" is defined by the victor, not by the law or the constitution.

No, "constitutional" is the rule of law of the Constitution itself AS WRITTEN and ORIGINALLY understood and intended which is essentially what we had for the first 125 years before the ungodly lurch to the Left in the 20th Century spiritually and politically.
Who is actually going to do their duty to stop tyranny? First you have to understand what that duty is, which many do not. It is not irrelevant - it is how uprisings against tyranny start because it puts you on the moral and legal high ground, very important.
Much of the reason we don’t have too many “whos” is many don’t understand their constitutionally protected rights and freedoms. For instance few get that states have the moral and legal high ground to nullify unconstitutional federal acts which are acts of tyranny.
Once enough people understood that, it would be easier to find those who would actually take that moral and legal high ground against the feds.
I can work with either definition of "constitutional," and prefer to not argue over what the label means. My point is that the victor claims his actions are constitutional. As you point out, the "rule of man" that the PTB impose these days is labeled "constitutional" by the courts and the government. The official word (for what that is worth) is that homosexual marriage, affirmative action, deprivation of rights by entry on a secret list, unfettered snooping, etc. are "constitutional."
SCOTUS has Alice in Wonderland powers, and it is eager to use them.
I don't personally grant them legitimacy, but if push comes to shove, they'd kill me and laugh about it.

I’ve given a reasonable definition of what is actually “constitutional” supported by renowned constitutional scholars such as Judge Bork. Left says its constitutional because SCOTUS says it is. Don’t let the Lying Left make up their own definitions for you.
