Court Must Dismiss Police Lawsuits Against Marilyn Mosby (says Michael Brown lawyer)

Lawsuits filed by Baltimore police officers against Baltimore State Attorney Marilyn Mosby must be dismissed, according to the law. The United States Supreme Court ruled that prosecutors acting within the scope of their duties in pursuing criminal prosecution are immune from civil suits.

The role of a prosecutor in a criminal case is to seek justice and represent the People of a given jurisdiction against a person charged with committing a criminal offense. This is exactly what Marilyn Mosby did when the officers involved in Freddie Gray’s death, which the medical examiner ruled a homicide, were indicted by a grand jury. …

Acting under color of law is not necessarily acting within the scope of duties. If it were, we sheeple would be subject to all kinds of terrible abuses by government agents and office holders. ( yes, I realize...)

I’m not a lawyer...but the prosecutor represents ALL the people, even the one accused....he/she must ensure a fair trial....

The ruling is that prosecutors (and others) when operating within the bounds of their authority and only when operating within the bounds of their authority are immune from being sued. At issue is where Marilyn Moseby was operating within the bounds of her authority or operating beyond the bounds of her authority. From her own statements it would appear she was operating outside the bounds of her authority.

Frankly, I hope Benjamin Crump marries Marilyn Moseby so the headline can read: “Mosely Crumps”.

I’m sure that’s in the works. What the Mosby suit will do (even if it is dismissed, which is likely) is flush out information to be used in the suit against the city.

Last I looked mosby hadn’t murdered anybody. Besides, she’s protected by the near same ‘unwritten laws’ on prosecuting government employees as the Police are. Particularly the technique of over charging them so that they get off scot free.

I agree with Mosby in that most of those officers, particularly the ones riding in the van should have been indicted and prosecuted.

I don’t agree with Mosby’s political and racial grandstanding.

Why? They were given a trial and the facts say otherwise.

Witchhunts have never been considered just doung their oficial job. Abuse of power is not just doing their job.

These can be proven if they ocurred. There will be things they did illegally under color of law. Stuff they kept hidden, things they would not want known because they know they were breaking the laws.
