That said, we got to be careful about what we do with 10th Amendment rights unless we want to bury that sucker so deep that even new originalists can’t get at it.
Article I, Section 8, clause 4 of the Constitution entrusts the federal legislative branch with the power to establish an uniform Rule of Naturalization.
So immigration is not really a 10th Amendment issue. States and cities should abide by laws passed by the US Congress.
