Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.
Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.
You just can’t make this stuff up.

Patently obvious, and President Trump would be a fool to fall into their trap. He has no legal obligation to engage in this foolishness. He should tell them to stick their order up their arses.
Really, who needs 14,000 words to say those three partisan hacks screwed the pooch, so the en banc crew should correct their mistake post haste, because...the law.

Rather then dividing the 9th Circuit Congress should simply pass a law prohibiting any judge in the 9th Circuit from hearing any issue related to the lawfulness of an executive order or an act of congress.
Don’t allow the 9th to have jurisdiction over any constitutional matter whatsoever.
Just strip these clowns of the ability to run their circus.

They aren’t afraid. They just want to bog Trump down in months of 9th circuit full court deliberations (followed by 4-4- at the SC.) It’s a trap. No doubt they are worried Trump may not take that bait and they might end up not controlling the situation.

I think we need to institute a quality control rule for judges on the federal level. after X reversals in a four year period by a higher court that judge is reviewed for possible suspension by the higher court. it just seems like a waste time and money when the justices decide to put out rulings that they know can’t stand the muster of judicial review.
