Ninth Circuit Court Now Demands It Be Protected From Itself…

Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.

Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.

You just can’t make this stuff up.

It was first announced on Fox Business, "Making Money with Charles Payne." While over on "Fox," Chris Wallace was hawking video that they "could have" any minute of Melania on Air Force One. I don't think he even had that aired.

Charles Payne is worth watching.

Let them think that they’re protecting their turf if they change their mind...they’re getting busted up ANYWAY. The 9th Circus is a large part of the swamp, and we know what Trump promised (and that he keeps his promises).

I agree with you. The Left will never stop fighting and will use any dirty means “necessary” to get what they want.

I think we need to hear from lawyers about what this really means and what the ramifications are.

That’s the thing. Only a small percentage of any appeals court’s opinions make it to SC review. Since experience demonstrates 80% of the time the 9th rulings are subject to review, they are wrong. There’s no reason to think their un-reviewed opinions are any more correct. But those un-reversed, 80% wrong opinions are the foundation of change the extremists need to keep destroying the American we are owed. The influence of especially THIS district has to be minimized.

I am concerned about the timing of this action so immediately following the decision.

I am wondering, are there those on the court that wants it off the 9ths docket and on to the Supreme Court while there are only 8 sitting Justices?

They likely heard Trump is coming out with a new EO shutting all immigration down. Well that and the bill before Congress to split the 9th Dist into two districts.

The reasons why the administration was right was in the original brief and thus the reasons why the court is wrong. In fact, a literal reading of the law should reveal completely why the court is wrong. Perhaps just that immigration law written in the 1950's should constitute the entire second brief with the most relevant words written in bold.

What . . . is "good behavior" about an 80% overturned rate?
That’s a biased statistic: 80% of the judgements which are appealed are overturned.

But if SCOTUS doesn’t accept an appeal, or if no appeal is made, those cases don’t count.

It would seem that, ideally (from the SCOTUS POV), the overturn rate of those appeals heard by SCOTUS should be high. If there is no chance SCOTUS will overturn, SCOTUS doesn’t want to hear the case.

I read that Justice Kennedy would decide whether this appeal from the Ninth should be heard; if that is generally true for Ninth Circuit cases that could explain the high rate of SCOTUS reversals. Kennedy is usually the swing vote on SCOTUS; if he goes conservative the conservatives win, if he goes liberal the liberals win. So it would seem that appeals he decides should be heard by SCOTUS are pretty much sitting ducks at the SCOTUS level.

Just guessing, and IANAL.

The (most-overturned) 9th is the only circuit court that does a “limited en banc” review, so instead of all 29 judges, it will be the chief judge plus 10 “chosen at random”.

I’ve never heard of this being done before. Of course, not being involved in litigation, I don’t pay a lot of attention to Circuit Courts anyway.
