You want to cite chapter and verse of the Constitution, followed by precedent, you make your case (pun intended); that *is* their job. But, it should be hammered home that the panel did not rule on the LAW (no mention, no reference, not even a side-ways glance), but ENTIRELY upon F-E-E-L-I-N-G-S and the prejudice of the their own political bent.

IMO, that breeches ‘good behavior’. They wish to be law MAKERS, they won’t\shouldn’t (technically, CANNOT) be doing so from the bench. Congress and the States should be doing more in this area than they have since the Courts self-endowment of ‘final arbiter’ status.

That’s a biased statistic: 80% of the judgements which are appealed are overturned.

But if SCOTUS doesn’t accept an appeal, or if no appeal is made, those cases don’t count.

It would seem that, ideally (from the SCOTUS POV), the overturn rate of those appeals heard by SCOTUS should be high. If there is no chance SCOTUS will overturn, SCOTUS doesn’t want to hear the case.

I read that Justice Kennedy would decide whether this appeal from the Ninth should be heard; if that is generally true for Ninth Circuit cases that could explain the high rate of SCOTUS reversals. Kennedy is usually the swing vote on SCOTUS; if he goes conservative the conservatives win, if he goes liberal the liberals win. So it would seem that appeals he decides should be heard by SCOTUS are pretty much sitting ducks at the SCOTUS level.

Just guessing, and IANAL.
