Trump Drops Defense of Obama Guidelines on Transgender Students

The Trump administration has dropped the federal government’s challenge to a nationwide injunction issued last year that blocked the fulfillment of Obama administration guidelines stating that transgender students’ access to bathrooms and other gender-segregated school facilities was protected under existing federal civil rights law.

The injunction was issued in August by Judge Reed O’Connor of the Federal District Court for the Northern District of Texas as part of a lawsuit filed by more than a dozen states over the Obama administration’s position that Title IX, the federal law that bans sex discrimination in schools, protects transgender students.

Under that interpretation, transgender students have access to facilities like bathrooms and locker rooms that correspond with their gender identity, a proposition to which social conservatives strongly object. They argue that allowing transgender students to use those facilities poses a threat to the privacy and safety of other students.

The Obama administration appealed the injunction and requested that it apply only to states involved in the lawsuit and not nationwide. Oral arguments in that case were scheduled to begin on Tuesday, but on Friday, the Justice Department withdrew the previous administration’s challenge.

“The parties are currently considering how best to proceed in this appeal,” the department said in a legal brief to the United States Court of Appeals for the Fifth Circuit.

The decision changed little in the short term because the nationwide injunction has been in effect since August, but it signaled a significant change in the government’s approach to transgender issues under President Trump. Mara Keisling, the executive director of the National Center for Transgender Equality, called the move a “callous attack” on “the dignity and safety of transgender students.”

A little common sense, thank goodness. Title IX was never meant to be a Federal mandate that boys be allowed to use girls' bathrooms.

Hussein the Clown stopped defending the LAW of the United States (Defense of Marriage Act, and the border laws just to name two).

So the fact that PRESIDENT TRUMP won’t go along with the Clown’s scribblings (not LAW) doesn’t bother me one iota.

This “transgender” bs is crap. If one has a penis stand up to pee. Use urinals. Women’s restrooms do not have urinals. If you are a woman that likes to stand up when you pee and can direct your stream into a urinal then by all means use either restroom. Males do not belong in female’s restrooms. PERIOD!

There was a case at my previous employer where a man “Came out” as a woman and began using the women’s room. Many women on our floor began going to lower floors to the restroom. Everyone in our department of 70 was offered counseling except the one person who needed it. IMO this individual was homosexual and the transgender was just an extension of that behavior. Nice guy and a pretty talented developer, but he was not a woman.

An extremely small percentage of the American population protected by laws we are told are in place because of our bigotry by the enemies within that make the 99.99999 percent of us uncomfortable in our own country. Ok...

I am not an architect but I did stay at a Holiday Inn Express last night. So let's say in the spirit of inclusion we construct a third bathroom. Have you been in an school that was built 20 to 100 yrs ago? where the floor plan is "X" and everything their is fully utilized and has a purpose? So how and where do you construct bathroom No 3, and where and at what price? And what other locations would this have been a requirement? Hotels? Airports? Libraries? Town-Halls? etc. etc.. Great work if you are a small contractor donating to the party in power, but did it make any of this make any sense.....

But standing to pee is bad for you. If yo sit, you more fully evacuate your bladder reducing the risk of cancer. I understand that Germany (though I haven’t been there lately) takes it so seriously that they have band urinals. Of course, what keeps men from standing at the toilet, I’, not certain.

It’s never/rarely mentioned it is also locker rooms and showers. So your Jr. High or High School daughters would be forced to deal with dudes having the “right” to share the showers and locker rooms with them. Obongo’s daughters were in private schools so no need to worry. The 3rd bathroom solution is not going to fly because schools that did that
were already being sued for stigmatizing the tranny’s

What is funny to me in all of this is that no one has said toilets and where and when someone relieves themselves is outside the purview of the federal government. In fact, I almost never hear anyone say that the vast majority of things government is involved in is outside the government’s role in a free society with limited government. It just shows how ingrained the idea of seeking government leadership is part of everyone’s psyche, even here. I remember years ago saying the FDA needs to go and receiving flak from people on this site. IN my opinion, the FDA, EPA, and Dept. of ed need to go. In fact, all public schools, or at least federal and state funding and oversight of them needs to go.
