The Utah Supreme Court has ruled police are allowed to ask for a passenger's identification and run a background check on them during a traffic stop even without suspecting criminal activity.
In a 5-0 decision this week, justices overturned a 2014 district court ruling that argued such police actions were "beyond the scope of a routine traffic stop."
The ruling stems from a case involving Utah Highway Patrol Trooper Jeremy Horne, who stopped a car for an improper lane change. Horne collected IDs and ran a background check on the driver and the passenger, George Matthew Martinez Jr.

They can request ID but passengers don’t have to carry it.
This will be overturned not because of constitutional issues, but democrats have proven that all minorities are too stupid to be able to obtain IDs
New traffic offense - “Riding in a motor vehicle without ID”.
Sort of makes me think of a 1941 era Gestapo checkpoint armed with a Schmeisser stopping a car and saying “Papers Please”.
Sorta makes me think of not being a meth head.
I am 70 years old and have never used any illegal substance of any kind. Never even thought about it. Still the idea of a cop stopping me for any reason other than an active criminal investigation where it is really indicated, irritates the heck out of me.
Why? You don’t want people with expired licenses and/or no insurance or registration off the road?
If you have your affairs in order, you’re fine.
If you don’t, you’re dangerous and should be off the road.
Sometimes the extremists for the term “Live free or die” get silly here.
People aren’t driving alone on the road.
Seems like a criminal background check for a job is more intrusive than checking to see if a license is valid.
Since when has driving, or riding with a presumably licensed driver, become a right?

The decision reads like it is a voluntary request for passenger ID. You can speculate on what happens next if the passenger says No.

You might want to think about the article. It isn’t about the driver, it is about IDing the passengers.
Well,everyone is irritated if they get pulled over,that’s life.
I would have sued on the basis of discrimination....last name Martinez.
Now, as it stands in Utah, it seems if the police want to check immigration status, they can....

Correct. Should always be the presumption of innocence unless observable that a crime is being committed. This is America, after all. Or it was. If rules are enforced, such as preventing illegal aliens from breaking the law, then yes go ahead and ask for ID and get them out of here. But with all the rules being ignored or broken, then the law shouldn't arbitrarily ask for your papers. Most of us are innocent of wrong-doing.
