This theoretical body is allowed under the XXV Amendment, but only if created "as Congress shall by law provide".

In order for a Bill to become law, it must be signed by the President, or passed over his veto by 290 Members of Congress and 67 Senators.

If they have the votes to do that, impeachment would be a much easier route to take.
