By law (28 USC 508), the Deputy AG becomes the Acting AG upon a vacancy in the AG position. The only way around that is through the Vacancies Act (5 USC 3345), whereby the President may select as Acting AG any Senate-confirmed official. See this DOJ OLC legal opinion: https://www.justice.gov/file/451576/download Now, on its face, the Vacancies Act would apply if Sessions resigned but not if he is fired.

So if Pres. Trump fires Sessions and tries to appoint someone other than Rosenstein as Acting AG, he may have a fight on his hands. The President may figure that firing both Sessions and Rosenstein at the same would make him look bad and drive Congress nuts, leading Paul Ryan to go after him through a Select Committee or some such Watergate-like witch hunt. So he would rather have Sessions quit so he could then appoint an Acting AG who will fire Mueller (Rosenstein will presumably refuse to do so).

The President’s tweets make sense if he has privately asked Sessions for his resignation but Sessions has refused. That would make Pres. Trump even angrier and would explain his tweets.

Yes I am a lawyer but past results do not guarantee future recoveries...

Limbaugh paid attention to Obama’s eligibility when
it was first out in the public realm but to pound
on it continually for 8 years would produce “the
same old schtick” as a certain poster has asserted.
Besides, how do you know how much time Rush spent
discussing Obama’s eligibility since you claim to
have quit listening to him in the 90’s? You can’t
have it both ways so you might as well move on and
not waste your time and mine.

I think you’re on to something. It would explain what is going on. If the only way around the vacancy act is Sessions resigning and of course only a fool wouldn’t see Rosenstein taking over would be a disaster at this point.
So this puts Trump in a box. So Rush says why hasn’t Trump gotten over Sessions recusal yet? Trump, his family, his friends are being put though a meat grinder because of Sessions recusal. No recusal no Mueller l wonder if Rush would have “gotten over it” by now if he was Trump.

Problem is, the deal has to include Witness Protection to ensure that the songbirds survive the ordeal, given how folks with info on Hillary suddenly catch that darn suicide bug...

As others have stated, it’s really very simple. Sessions made his first critical error in recusing himself from the “Russia” investigation. His second critical error was in selecting Rosenstein as Deputy AG. Those two errors have compounded each other and had reverberating, cascading consequences that seem to increase in magnitude over time. The answer is to replace Sessions with an AG who is not conflicted with respect to the Russia investigation and can therefore take over that investigation from Mueller and revoke his appointment as independent counsel. A new AG would be entitled to his own deputy, which would also mean replacing Rosenstein. By replacing Sessions and Rosenstein, and removing Mueller, virtually all of Trump’s current problems due to the Russia investigation could be resolved. The only difficulty would be in selecting a replacement for Sessions (such as Giuliani) and getting that person approved by the Senate. I like Jeff Sessions and acknowledge his contribution to the Trump election. However, how many mistakes should a supporter such as Sessions be allowed to make, and how long should the harmful consequences of those mistakes be allowed to continue, before it is concluded that the supporter is too much of a liability to remain in his present position?

My dream is that Grand Juries have been in session for a couple months already, and it’s just a matter of a very short time before simultaneous arrests are made within a 15-minute time span.

A Grand Jury is the only way to handle this. Those stupid “investigations” by legislative committees never amount to anything serious. They’re just venues for the pols to showboat, grandstand, and peacock for their constituents’ benefit. They’re a complete waste of time. Grand Juries are serious, final, and they’re generally secret so the MSM can’t be hovering and questioning as the process goes on.

Rudy would never be confirmed by the Senate. Neither would anyone else worth a damn. The Dems are running scared. Losing Sessions would play into their hands. He may disappoint some people in some aspects but he is made of a lot sterner stuff than many think.
