Environmental groups denounce Trump override of climate plan

HAZARD, Ky. (AP) — A coalition of left-leaning states and environmental groups are vowing to fight the Trump administration's move to kill an Obama-era effort to limit carbon emissions from coal-fired power plants.

Speaking Monday in the coal-mining state of Kentucky, Environmental Protection Agency Administrator Scott Pruitt said he would be issuing a new set of rules overriding the Clean Power Plan, the centerpiece of President Barack Obama's drive to curb global climate change.

"The war on coal is over," Pruitt declared, adding that no federal agency should ever use its authority to "declare war on any sector of our economy."

It was not immediately clear if Pruitt would seek to issue a new rule without congressional approval, which Republicans had criticized the Obama administration for doing. Pruitt's rule wouldn't become final for months, and is then highly likely to face a raft of legal challenges.

New York Attorney General Eric Schneiderman was among those who said they will sue.

"The Trump Administration's persistent and indefensible denial of climate change — and their continued assault on actions essential to stemming its increasing devastation — is reprehensible, and I will use every available legal tool to fight their dangerous agenda," said Schneiderman, a Democrat.

For Pruitt, getting rid of the Clean Power Plan will mark the culmination of a long fight he began as the elected attorney general of Oklahoma. Pruitt was among about two dozen attorney generals who sued to stop Obama's 2014 push to limit carbon emissions, stymieing the limits from ever taking effect.

If Pruitt's rule is a reasonable interpretation of existing law, the decision is not reviewable by a Court under the Chevron Deference doctrine. And it does not require additional Congressional authorization.

Don’t you Trump people understand, this is how it works: What Obama decreed by executive order is now REQUIRED, even though it never previously existed. Trump’s attempts to reverse Obama’s decrees are Unconstitutional, even though the Constitution didn’t require them before Obama. Why? Because.....Soros.

Obama didn't need the consent of Congress and neither does Trump.

In 2007 SCOTUS ruled that CO2 was a pollutant and told EPA to determine the risk that CO2 posed to the nation and if needed, EPA could regulate CO2 with Clean Air Act, which means they did not need any new legislation from Congress.

But Obama agreed with most everybody else back then that Congress should be given a chance to preempt EPA and enact new legislation to regulate CO2.

That was called the House Cap and Trade Bill that the House passed in 2009 but the Senate didn't pass it so Congress failed in their attempt.

Only after Congress failed did Obama move forward in 2010 with his first set CO2 regs. Obamas second set of CO2 regs was the Clean Power Plan in 2015 and that is what Pruitt is trying to undo now. That case is still before the DC Court of Appeals so the attempts by Trump and Pruitt to undo the CPP is not an automatic done deal.

Whatever happens, Trump definitely doesn't need approval from Congress because SCOTUS gave EPA the authority in 2007.

More Winning by Trump. Maybe a conservative Senator will be elected from West Virginia that is Republican (both are now Democrats but I view them as more conservative than some RINO Republicans.

If Environmental-Wackos are mad/upset, that is GOOD, GOOD NEWS.

The leftist's persistent and indefensible denial of the lack of science of climate change, is the real problem. That is, the science is far from settled!

The leftists melt away when asked to show the science supporting their claims of climate change being caused by mankind. The well funded leftists are guilty of lysenkoism.

The entire country and world would benefit by a red team/blue team assessment of the role of mankind in climate change. Real science will show that the dominate factor in climate change is the Sun.

Lysenkoism is used metaphorically to describe the manipulation or distortion of the scientific process as a way to reach a predetermined conclusion as dictated by an ideological bias, often related to social or political objectives. It is a reductive view of human nature and action, based on selective evidence, unexamined assumptions, and jargon modeled on real science.

As far as I'm concerned, "environmental" groups are enemies domestic.
Have been from the getgo and never "woke up."

Having personally witnessed the progress of "environmental" laws, a great idea, taken over by nut cases just deteriorate and degenerate into another tool of enemies as bad as antifa or ISIL or BLMs...

If this wasn't so sad and serious, it would be hilarious.

Yes, Republicans did oppose it, but The Magic Negro ignored them as he tried to use his magic pen and phone and use an E.O. (Executive Order) I think that didn't work.

As for the "raft of legal challenges," What made that attempt "the right thing to do" and in the best interests of our citizens when the Magic Negro attempted it but a "horrible choice" when a rational new adult president adopts the exact same strategy?

This topic keeps screaming for a thorough debate on the science aspect of the issue, according to the Federal Rules of evidence, excluding political hacks (e.g. Al Bore,) but with real, reputable accomplished scientists (Nobel Prize Winners?) in Science participating.
But no one in D.C. will embrace the obvious to end the stupid food fight once and for all..
