Kurtz: The Democrats' Impeachment Fantasy

Nancy Pelosi is running away from impeachment.

And the fact that she’s doing so speaks volumes about where her party is in the Trump era.

Let’s start with the inconvenient fact—inconvenient for Democrats—that President Trump hasn’t committed anything close to an impeachable offense. Critics can skewer him over his policies and persona, or speculate about what the Russia investigation might find, but mostly they just wish that somehow he could be magically removed from the White House.

That, however, is not the view of much of the liberal base that can provide the energy and the money as Pelosi’s party pushes toward the 2018 campaign.

A smart piece in Politico says the House minority leader has privately criticized a $10-million ad campaign pushing impeachment by Democratic mega-donor Tom Steyer:

“Pelosi is eager to show her party can govern — in contrast to the chaos surrounding Trump — and she believes that a reputation as the ‘no drama’ Democrats is key to taking back the House in 2018 and whisking her backing into the speaker’s chair.

Democrats are held captive by their base; they can’t move on from Russia and impeachment.

A year later, they still haven’t figured out why they lost the election.

Their plight is truly the gift that keeps on giving, since all their compromised leaders are still the face of their party.

And with all his problems, Trump is still far more popular than them.

The only ones that could make impeachment/removal a possibility would be the GOPe in the House and Senate, and only if they all joined in. It would lead to each and every one of them being voted out of power. If they succeeded, it would cause the republic to descend into violent upheaval. Being the pragmatic creatures that they are, this gives them pause.

If they wait until after the 2018 election, there won’t be enough GOPe left in the Senate to pull it off, in any case.

If Dem somehow can win in 2018, Pelosi is still going to be their guy?

Seriously? The only smart thing she did was that she didn’t alienate either Sanders’ or Hillary’s supporters.

My fear is that Mueller will have his all Democrat grand jury indict Trump on some unrelated financial crime, and that he will be forced to stand trial before a Democrat judge and an all Democrat jury. There is no way he would escape conviction under these circumstances.

Facing this, he may be forced to resign in exchange for dropping the charges, regardless of how bogus the charges may be.

There is a reason Mueller moved the proceedings from the grand jury in northern VA to DC. The jury went from being racially and politically diverse to being all Black and All Democrat.

I am not a lawyer. That said, a case can be made that any jury in DC is prejudiced against Republicans and Trump by virtue of polls, election results and media coverage. We are still guaranteed a jury of our peers. At the very least, juries need to be composed of a cross-section of the national electorate.

This may all be moot, actually. I believe Presidents cannot be tried in civilian court while serving. The only allowable Constitutional venue is Congress and they need super majorities to impeach and convict on very explicit, specific grounds, which have not been met.

A jury of your peers means a cross section of the citizen population, randomly drawn, from the the relevant jurisdiction (here, the District of Columbia), not the entire country.

I don’t know about a trial in a civilian court. Maybe impeachment is the only remedy, in which the “trial” would be in the Senate, although he probably could be tried after he leaves office in court. I don’t think a Senate trial would place him in “jeopardy” for the purposes of double jeopardy.

So far the justification for impeachment is of such low quality that one would have to assume that if President Trump was removed from office that his successors would quickly follow until the country exhausted its supply of qualified Republicans. Rather than having a government representing representing the “will of the people” we would inherit government representing the whim of the elite few.

It was debated during the Watergate investigation whether President Nixon could be indicted while President. It appeared to be a murky area with opinions on both sides of the question, but the de facto consensus was that a President would need to be removed from office before being indicted. So Nixon was listed as an "unindicted co-conspirator."

Maybe Mueller plans to do that to Trump. No matter how ridiculous the charge, it would give Paul Ryan a green light to start impeachment proceedings.
