It would probably be very difficult to make a case stick against Mueller (otherwise, prosecutors would be sued like this all the time).
Rosenstein, on the other hand, is a whole different story. Since he recused himself from the Russia-Trump idiocy and appointed Mueller to act as the "prosecutor" in the matter, he may have compromised any claim he might have for immunity as an officer of the U.S. Justice Department in the matter.

This country could very easily fall under a Dictatorship by Special Counsel if any President can command the appointment of Special Counsel and then that Special Counsel can prosecute whatever scope of investigation they want to take without any limitations whatsoever. One of the reasons to do this is that Federal civil discovery rules are much, much more broad than in criminal cases. There is very little discovery afforded in Federal criminal cases. It’s a old lawyer trick.
