Governor denies clemency to Army veteran with green card who is facing deportation

Illinois Gov. Bruce Rauner has denied clemency for an Army veteran and green card holder with a felony drug conviction, according to both the man's lawyer and his mother, who said she got the news in a letter from the governor's office Wednesday.

Advocates had hoped a pardon from the governor would encourage the government to grant citizenship to Miguel Perez Jr., retroactive to when he joined the military in 2001. His attorney, Chris Bergin, applied for citizenship on Perez's behalf in July.

That retroactive application for citizenship is the only pathway left for Perez, 39, after a three-judge panel for the 7th U.S. Circuit Court of Appeals denied a request for relief under the United Nations Convention against Torture, a protection that resembles asylum. He and human rights advocates believe his life would be in danger if he were sent back to Mexico, where he hasn't lived since age 8.

What was his service record? Why did he join and in what unit(s) did he serve? I thought that enlisting in the military would somehow grant you a pathway to citizenship.

A pathway, yes ... but he assumed that he became a citizen when he took his oath of enlistment.

It sucks, given his good service in the military, but he got out and let a "friend" steer him into the drug-dealing business. That gives him a felony, and that leads to a one-way ticket out ...

Oops. I would think that if he had joined under some program that would have resulted in him being promised citizenship, he would be a citizen by now.

Evidently he didn't join such a program, or he didn't take advantage of it.

I would actually support it if he had.

He didn't need a special program. As just a “green card holder” he was eligible for citizenship after 5-years and as a member of the US military that is/was cut to 2-years.

The fact that his “advocates” are asking for it “retroactive to when he joined the military in 2001” means he was already eligible for citizen before his service and US citizenship didn't mean that much to him then or during his time in service.

Make me wonder why he joined the US military when he didn't even want to be a US citizen. Seems he only now wants US citizenship to avoid deportation for his drug convictions.

One has to wonder just how clean his 201 file was when he was discharged knowing that he got into selling drugs.
