Re-rereading my past comments, I see that I unfortunately managed to give the impression that Congress actually could directly appoint Executive Branch officials, instead of having the power to control who may appoint them. For that, I must apologize. My statements were poorly worded.

That's fine. Everybody words things poorly now and then. But it was that wording that lead me to not take the rest of what you were saying seriously. And as it turned out, you did make a couple of good points.

I've never denied that the Senate has the power to deny the appointment of primary officers. That's their power of consent, of course.

Perhaps you worded that comment incorrectly too.

As I see now, the Senate does have the power by law to grant "department heads" (instead of the president) the power to appoint (and fire) inferior officers.

Perhaps that's what you are referring to.

And it's that point that I'm conceding.

Although I must say both myself and apparently Madison aren't/weren't big fans of that subclause.
