Alabama has reportedly filed a lawsuit challenging the federal governments practice of counting undocumented immigrants in its official Census Bureau population counts.
The state filed a lawsuit in federal court Monday arguing that the new census numbers for 2020 will result in Alabama losing a congressional seat and a vote in the Electoral College to a state with a bigger illegal alien population, according to the Associated Press.
The state of Alabama and Rep. Mo Brooks (R-Ala.) are the plaintiffs in the suit.
Citizens and noncitizens with a residence in the U.S. are included in official census and apportionment counts.

Yes. I voted for Mo in the primaries. He did not make as much noise and get as much traction as the other two. Less name recognition and money.

By definition, illegal aliens are not legal residents and thus should not be counted.
Another successful Bush League Republican operation to prevent US (US citizens) from electing anyone who would side with US and the rule of law.

Foreign nationals, here legally or unlawfully, should not be counted in the Census.
Everyone should be counted, but only the citizens count should be used toward congressional districts.
Given that each congressman represents 759,000 people, and 11 million illegal aliens, that means that sanctuary states like California have 14 congressman representing illegal aliens, almost all in democrat states.
Actually, a very good point! We need to know how many foreign nationals are in our country, both legally and illegally.
Keep the count, but make illegals have no affect on representation.
The only problem with that is the Constitution - specifically the 14th Amendment:
"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed."
Pretty clear "persons" means everyone since "citizens" and "legal aliens" were also terms they could have used.
Well, if that is the case, send INS officers with every Census taker...

The Constitution stipulates that all “Persons” should be counted.
That said, it would be interesting if the Supreme Court ruled that a Person was someone here legally. That would then include foreigners here legally, but would exclude illegal aliens.
Interestingly, it actually refers to “Free Persons” (due to slavery at the time of the signing) and “all other Persons” (slaves and indentured servants at the time). “All other Persons” are counted as 3/5ths of a Person. I wonder what the court would say about an illegal being considered a “Free Person” given that they are here illegally and subject to incarceration and deportation?

Foreigners residing here legally will always be counted, absent a Constitutional Amendment, because a great many people here when the Constitution was signed were non-citizen residents and they were intended to be counted at the time.
People here illegally are another matter, however, although clearly they’ve been counted in the past.
At least that’s how I see it.
Interesting. I didn’t realize the 14th covered the issue too.
Still, I think a case could be made that people here illegally can’t justify obtaining representation in Congress. That seems illogical, because it is. Sort of like a home burglar getting caught in the act and claiming he’s entitled to be there because, well, because he’s there. Not logical.
I wasn’t even aware this was the case. WTF?! So California gets extra ECs simply because it is riddled with illegals. Call me stupid, but doesn’t that create a built in incentive for large Democrat stats?
