The nightmare scenario Sen. Claire McCaskill (D., Mo.) laid out last year when asked in private about whether Democrats should obstruct Neil Gorsuch's Supreme Court confirmation is coming true with Justice Anthony Kennedy's retirement.
McCaskill warned in leaked audio released last March by the Kansas City Star that Democrat opposition to Gorsuch could end up biting them in the future should more seats open up while President Donald Trump was still in office and Republicans controlled the Senate. Democrats, however, made clear they planned to filibuster his nomination, pushing Republicans to employ the nuclear option, lowering the confirmation threshold to a simple majority.
"I’m very uncomfortable being part of a strategy that’s going to open up the Supreme Court to a complete change," McCaskill told the donor crowd, explaining that obstruction would simply push Republicans to move to 51 votes for confirmation.

Anything that makes Democrat Claire McCaskill usually makes me happy.
Or at least a sad face on Democrat Claire McCaskill is a good thing.
And that was before she choked on a handful of chicken gizzards.

What she didn't tell her donors is that Harry Reid invented this tactic.
The actual departure of the corpus of RBG from the Supreme Court bench would surely cause heads to explode all over many of the “blue” enclaves throughout these United States.
So long as these the denizens of “blue” America can pretend RBG still lives, they can take some small comfort that the vote will still always be 5-4 on any ruling, and therefore only marginally held to be legal. Once it becomes 6-3, they know the major “advances” in jurisprudence almost certainly be revisited, and the carefully structured house of cards they have erected will surely come fluttering to the ground.

I remember reading before the 2016 election, Ginsberg said if Trump won the Presidency, she would leave the country..I’m still waiting. Of course a whole lot of unhinged lefties were going to leave the country, that plane is still waiting.

The gop should save us all a lot of trouble and cut to the chase by using the nuclear option.
The entire point of this article was that this had already been done when they chose to obstruct Gorsuch, and therefore, the filibuster is no longer on the table for them to block the current nomination and they may have been able to use it to block Kennedy's replacement. The GOP already went nuclear...that's over and done with.
