Exactly. How is this not involuntary manslaughter? I don’t care how contrite his sex partner is about the event.
It seems crazy that the prosecutor lets this walk, and doesn’t at minimum put it in front of a grand jury. And really it should just be prosecuted and let a jury decide.

This reminds me of a scene in the show American Crime The Assasination of Gianni Versace. Andrew Cunanan wrapped up some old gay guys head in duct tape and let him start breathing heavy before punching holes in the nose and mouth area. I mean he still killed the old queen, but it was such a creepy scene.
