Federal judge orders Trump admin to restart DACA program

A federal judge on Friday said the government must restart the entire DACA deportation amnesty, including accepting brand new applications — but gave the administration a chance to appeal before his ruling takes effect.

The ruling by Judge John D. Bates is a major blow to President Trump, and creates even more confusion about his immigration policy.

Judge Bates said Mr. Trump and his Homeland Security Department do have the power to revoke the Obama-era DACA program, but they cut too many corners in the way they tried to do it.

The Judge has probably given Trump a trump card, in that certiorari is almost assured, and the fact that the Judge exceeded his bounds exponentially, over previous nearly-identical suits, will bring shame upon himself and his previous rulings.

Where in the Constitution does a judge get the power to order the executive to do or not do something?

I know that in The Anti-Federalist Papers we are warned that the judiciary will gather unlimited power unto itself and attempt to become tyrannical. Have we reached that stage?

I recall another Federal judge saying so as well. Given the current and future complexion of the SCOTUS, today’s ruling will be short lived and meaningless.

How can you take an action that is not under the province of a court to a higher court??

EO’s are presidential activities, they re not laws upon which courts typically oversee

He can stop DACA dead in it’s tracks with a rescission of previous and writing a new one

And of course you had to toss a pie in the Sessions direction just to amplify your posts worth

How come last week a federal judge said that the government can't stop private individuals from openly carrying a gun-but that was only good in the 9th circuit.

Now this week, a federal judge says DACA has to be continued and that has to be nation wide.

This chit is really starting to not add up.

And that leads to trouble.

Nah, I think Trump should have a lawyer review every ruling the judge ever made and recommend to Trump how the judge should have ruled on each. Then let Trump just quickly re-do all the judges rulings as he see's fit--including this last one. If anyone objects that its not the President's job to re-do the decisions of federal judges, then there is an obvious rebuttal....

..........I feel it is time for the president to defy the orders of Federal Courts and bring this immediately to the Supreme Court for clarifications............

The problem with that is there are only 8 Supreme Court Judges, it would be 4/4.

If this were to happen I believe that the lower courts decision would stand.

Am I correct?

Screw that a-hole.
DACA is unconstitutional.
Therefore the judge has no standing to order Trump to do anything with it.
Trump should tell this judge “GFY, asswipe!”
