Ginsburg Illness: If Trump Appointee Replaces Supreme Court Justice It Will Be 'Brutal,' (trc)

After Supreme Court Justice Ruth Bader Ginsburg missed her first oral arguments in more than 25 years on the bench this week while recovering from an operation to remove two cancerous growths from her left lung, many have expressed concern over whether she would return to the bench.

While doctors have said that Ginsburg's recovery time would be "normal" for the procedure she underwent, the 85-year-old's third struggle with cancer comes at a critical time for the Supreme Court. If Ginsburg, who will turn 86 in March, is unable to return to the bench, President Donald Trump would have the chance to nominate a third Supreme Court justice to the highest U.S. court.

True statement. Kavanaugh was just a warm-up. The RBG replacement fight will be brutal and ugly. It may even have a body count.

There are not Obama Judges or Trump Judges, judges rule on the law.

why shouldn’t anyone be able to be nominated then?

This confirmation process will show how intolerant the left truly is... televise it all with presidential commentary.

No. Their argument is that Republicans choose the worst possible judges for the Court. That there are no good Republican judges.

I read Chief Justice Rhenquist was undergoing cancer treatment 2004 -05 and missed 44 arguments but voted.

Yes, they shot their wad with Kavanaugh. Now we have 53 in the Senate, so that won’t work. And if President Trump nominates a woman, the Dems will have to take on a woman. That will not look so good.

Fox News Harris Faulkner just read news RBG will miss next week at the Court as well.

A very significant point, given the following, FTA:

Ginsburg's absence from the bench has left supporters particularly concerned, as she bounced back fairly quickly from previous cancer surgeries in 1999 and 2009. During both episodes, Ginsburg did not miss a single oral argument . (My emphasis.)

Now, after 25 years on the bench, Ginsburg has brought that streak to an end, missing oral arguments for the first time on Monday. It's not clear whether she will be able to participate next Monday, when another round of oral arguments is set to begin. (My emphasis.)

Looks more and more like the lay person medical prognosis given for RBG by the amateur oncologists here at FR is the right one.

RBG would have to die in order for that seat to filled. Otherwise, she can be MIA for as long as she likes or needs to, and I see little being done to un-seat her during that time.

I think it will need to be "proven" that she is dead before there is consideration for Trump to fill the seat.

That’s a good point. That also makes me question the wisdom and precedent of declaring a “national emergency” to get a domestic spending priority funded, though.

Why will it be brutal? The republicans hold a large majority now than during the Kavanaugh battle. Besides, I believe Trump will nominate a woman to replace RBG - hard to accuse a woman of sexual impropriety without coming off as completely tone deaf.

Trump will and should choose a conservative.

He knows this, and everyone else does too.

Will be difficult for them to revoke a woman choice.

Oral arguments are dog and pony shows, which is one reason you almost never hear of Clarence Thomas speaking up during orals. He's on record as saying they could and should be done away with. Personally, I like reading through the oral arguments, but they don't really tell you much about which way the court is going to ultimately come down.
