Federal employees forced to work stand to gain at least $1,160 on top of back pay

Hundreds of thousands of federal employees could collect late-pay penalties of at least $1,160 each — on top of anticipated back pay — after missing a second paycheck Friday due to the ongoing partial government shutdown.

The supplemental pay is being sought under a Great Depression-era law that authorizes damages for workers who are not paid on time, with potential government liability nearing $500 million as workers end a second pay cycle without a check.

A law firm representing workers suing under the Fair Labor Standards Act began a lawsuit sign-up drive Thursday on 2018governmentshutdown.com. FLSA lawsuits require opt-in, and many workers missed an opportunity to join a successful FLSA lawsuit following the 2013 federal shutdown, which resulted in four days of extra pay in addition to back pay.

The federal employees will still have their annual leave and accumulate more during the “shutdown”. Essentially, they could get weeks off of work, and then take more time off by using their annual leave.

No one is forced to work! This story is BS.

If you're not being paid and can't hang with it, go find another job like millions of other American would have to do.

Simple.

Those poor suffering people. Will they even live long enough to collect?

As long as they have been working then they should get back pay. But those who have been sitting home should be collecting unemployment, and in no way deserve any back pay. It would be fraud on the taxpayer to pay those people who didn’t work- one dime of back pay.

If you have questions for me, put them up right here on the public forum and stay out of my PM.

Happily. You are aware that all Border Patrol agents are currently working without any pay, right?

So what?

If they’re not getting paid and can’t hang with it, find another job like millions of other American would have to do.
Is this too complex for you?

This could go on a while. Perhaps it is a good time for Federal staff to find gainful employment in the private sector and generate net positive revenue rather than a net negative.

No one is forcing them to work. They are free to quite anytime.

Because the Border Patrol agents cannot do that.

“The federal employees will still have their annual leave and accumulate more during the “shutdown”

False. No leave can accumulate during the furlough for non excepted employees. However, any planned annual leave during the shutdown will be reinstated following resolution.

Also, non excepted Federal workers cannot volunteer their time to their jobs during the shutdown.

So you would like all border patrol agents to quit? Nobody can be hired to replace them during the shutdown. How about federal prison guards would like all of them to quit as well?

Because the Border Patrol agents cannot do that.

Are you suggesting they're not allowed to quit and go find other work?

#12 speaks for itself. If some of them can’t deal with it, fine. Go seek other work. Why is this so complex?

No one is forced to work!

At a minimum, Coast Guard personnel are.

Don't know if this payment applies to them, though.
