Confirmation of Lowenstein’s Paul Matey Flips 3rd Circuit to Republicans

The U.S. Senate voted by a 54-45 margin on Tuesday to confirm Paul Matey to the U.S. Court of Appeals for the Third Circuit. With Matey’s confirmation, the Third Circuit shifts to a 7-6 majority of Republican appointees, making it the first court of appeals in the nation to see its composition switch under Trump, who has been clear on his goal to remake the federal judiciary with conservative judges. Trump previously appointed Stephanos Bibas and David Porter to the 14-member court of appeals.

On Monday, after a vote to close debate on the Matey nomination was split on party lines, Sen. Robert Menendez, D-New Jersey, sharply criticized Republicans for advancing Matey’s nomination without the consent of the two home-state senators.

Ninth Circus got tied 9-9 a couple of weeks ago - with several vacancies remaining.

Nope, not even close ...YET.

The 9th Circuit Court of Appeals consists of 29 Judgeships with 5 being VACANT (Come on, Republican Senate). Of the 24 sitting judges, 16 are ‘RATS (9 Clinton appointees & 7 Obama appointees) and 8 are Republican nominees (5 Bush and 3 Trump appointees). So the Republicans on this Appeals Court are currently outnumbered two to one (16 to 8). Quickly filling the 5 vacancies with Trump appointees will go along way toward evening things out.

In addition to the five 9th Appeals Court vacancies, there are also currently TWENTY FOUR District Court Judgeships VACANT in the 9th Circuit Court of Appeals’ (CCA) area of responsibility. Hopefully these will be filled quickly with Trump appointees IF LINDSEY GRAHAM doesn’t allow the ‘RATS to veto them with the BLUE SLIP process he plans to allow for District Court nominees.

The tradition of giving the home State Senators a say is to speed up the process not slow it down! Senators would almost always support someone from their own State, no matter what their Party.

Am I a bad man for chuckling gleefully at this turn of events? Is it a sin to hop around like a bunny at the thought of more and more federal courts being forcibly restructured back to constitutional originalism? Grinning folks want additional fodder for pure amusement that is totally at the expense of the leftists!

It likely won’t take that. ALL 9 of the Clinton appointees on that appeals court are NOW eligible for “senior status” or retirement. Every time one elects retirement or senior status, another vacancy opens for a Trump nominee.

The same thing applies (or shortly will) to the GW Bush nominees. Remember, they were appointed during a time when the ‘RATS could still use Blue Slip “veto” to remove any Republican nominee not sufficiently “moderate” (aka “squishy”).

I said it the first day when Trump was in office: he stated he will change the judiciary in our favor as his 2ND PROMISE, (first which is the WALL). He knows the country may tilt to the left after he leaves and just like obamatard..he’s leaving landmines for the incoming presidency after him.

Without judicial review we don’t have a Law of the Land as required under the constitution but a series of overlapping, contradictory legal codes. Are 9th district rulings to stand without judicial review?

As Trump turns the judicial system you will see the importance of judicial review to producing a Law of the Land.
