Gateway Pundit ^ | March 20, 2019 | Jim Hoft

Posted on 03/21/2019 2:24:34 PM PDT by Albion Wilde

For several years The Gateway Pundit has reported on the plight of Sgt. Derrick Miller who sits in prison for life in Leavenworth, Kansas.

Today we are pleased to announce that Sgt. Miller will soon be released from prison!

U.S. Army National Guardsman Sgt. Derrick Miller... from Hagerstown, Maryland, was convicted in July of 2011 for the pre-meditated murder of an Afghan man in 2010.

Sgt. Miller shot and killed an Afghan civilian following the civilian attempting to grab Sgt. Miller’s weapon during a period of intense questioning. The Afghan civilian was a suspected insurgent that was walking through Sgt. Miller’s “platoon defensive perimeter observing their defensive positions”....

I remember hearing about this case and thinking something didn't sound right about the way it was presented.

And like you, I don't think Gohmert, would have invested as much time and effort into helping Miller, unless the evidence lead him to believe some type of injustice had been done.

I have now read through 85 replies.
I remember the original requests for help to free him and how the story seems to have evolved is unbelievable.

Testimony from a person with freedom for his family in the US and failure to allow the testimony of his own men still seems outrageous to me.
I do not seem to clearly remember interrogation being part of the original explanation. Defensive action without first being fired upon, to save his group, was the explanation.

I wish I could go back and read the stories. I felt justified in appealing for a review of his case at the time. Those who judge him harshly from this story might do well to return to original coverage too.

“A travesty of justice that he was jailed in the first place!”

Half of American voters put an enemy combatant in the White House, and ALL of Congress supported the Fraud.

The Fraud also sacrificed 15 Seal Team 6 commandos to his terrorist BFF’s for allegedly taking out obama bin laden.

That’s not what the stories I read said. Regardless, who coaxed the terp to lie? Who promised visas for his family and him? Will THOSE people be punished?

Those are good things except for the unintended summary execution of the alleged spy. That is the problem, was he actually a spy? Did they wrestle for the gun? The only thing that changed was the “premeditated” He did not wake up that morning and lay a plan to kill that man, it just happened. Was the man trying to set them up for a mortar attack or gathering intel. Very possible, in fact likely, but we will never know.

None of that stands as heroic actions they are in fact patriotic. I have heroes, men you will never hear of. I know what they did and I know they did it because they loved the men they served with. They did multiple combat tours or volunteered for convoy ops out of a sense of responsibility. Most paid heavily for their patriotism. All of them would correct you if you called them heroes. Which is why I do not use the term hero lightly.

From the link: “While Derrick does not dispute the validity of his conviction, the approximately five years he has already served is enough to atone for any crime he committed.” In this case the sentenced was excessive.

Look the Army and Marine Corps has a bit of a track record for excessive punishment or false accusations during the war. War is messy and the PC culture in the military cannot handle messy. Do not kid yourself the current crop of Generals have all suckled at the tit of Political Correctness as has every Colonel that wants a promotion. That's why Mattis stood out, frankly Mattis could not hold Chesty’s jock strap for him and Patton may have put him in charge of the coffee mess. We have a lot of Powells and very few Schwartzkopfs if any.

Specific question is whether he can sue for wrongful imprisonment with clemency? From the hip, I’d say no, because his conviction is not being overturned, just shortened (with some possible other conditions). Sucks, but at least he’ll be out.

I was copying you on my response to the post the other guy made to you; my remark was aimed at him, not you. FR does not have a "CC" function.

Hello, dear FRiend! Great to see you posting.

I agree with your summary of the point of his actions, and in fact because he credibly believed the man was a spy infiltrator, he told his men to reposition themselves; within the hour they were fired upon from three directions, but they all emerged unhurt. Had they maintained their prior positions, they would have been killed. Derrick's order saved them.
