Oberlin Punished for Fact-Free Food Fight

Oberlin College in Ohio has devolved into one of academe's most infamous examples of political correctness, one of those unwelcoming places that rails against anyone who brings speakers to campus if those speakers upset Oberlin's crusades against the racist/sexist/anti-gay menace.

Now Oberlin's administration is being punished in a very significant way for a very significant offense, and it's about time. It has taken political correctness to an abusive extreme. The Wall Street Journal opinion section headline summed it up: "Oberlin Pays for Smearing the Town Grocer." It has been ordered to pay $44 million in damages to Gibson's Food Market and Bakery. How so?

On Nov. 9, 2016, a black male Oberlin student attempted to buy wine at Gibson's using a fake ID. Allyn Gibson, a grandson of the market owner, refused to sell alcohol to the underage student and then noticed he was hiding two bottles of wine under his shirt. Gibson called the police, and the student tried to run off, dropping the bottles on the floor. When Gibson pursued him, it turned violent. Police arrived to see Gibson on the ground being beaten by the black male and two black female Oberlin students.

In court, all three students pleaded guilty, and the male suspect swore in a plea statement that Gibson "'was within his legal rights' to detain him, and that he did not believe Gibson's actions were racially motivated," said the Journal.

Yet none of this stopped Oberlin's students and administrators from mangling the truth. Because the assailants were black, students raucously protested, falsely claiming the store was racist. Worse yet, Meredith Raimondo, Oberlin's dean of students, "handed out a flier accusing Gibson's of having a 'long account of racial profiling and discrimination,'" the Journal said.

The Gibson family sued Oberlin and Raimondo, seeking $12.8 million at trial on a number of counts including libel, intentional infliction of emotional distress and interference with business contracts. The college canceled the store's longstanding food contracts. Boycotts and controversy took their toll. The store owners took no salary for two years, and nearly all the staff members were laid off. Gibson's lawyers lamented that if they did not receive a ruling in their favor, they would be forced to close up shop. But the truth won.

Raimondo led a crusade inside the Oberlin administration. A text message was read during the trial in which she discussed whether to "unleash the students" on Gibson's. This was war.

Cornell Law professor William Jacobson, who covered the case persistently on his blog, Legal Insurrection, told Fox News host Tucker Carlson that the Gibsons did nothing wrong. They were literally just minding their business that morning when they called the cops on a shoplifter. "Because of the crazed ... so-called social justice movement on our campuses, they were immediately designated oppressor, in part because of their skin color, in part because they're the owner of a business," Jacobson said. "And they were put into a pigeon hole of someone who ... must have engaged in racial profiling."

A massive verdict against a prestigious private college must have been national news, right? It wasn't. The same networks that savored every morsel of the scandal of Hollywood actresses partaking in college admissions scams offered nothing on Oberlin's defeat. Only Fox News found the facts of this disturbing court case worth discussing.

This is why the other networks hate Fox News with a passion. They can't bury these stories so a national audience never hears them. They prefer the narrative that political correctness never, ever goes wrong.

<><> 18 U.S.C. §241(Conspiracies Against Civil Rights). Violation of Civil Rights under Color of law and conspiracy. Conspiring with others to violate 4th amendment rights.

<><> Possibly full investigations centering on RICO conspiracies under 18 U.S.C. §1962(c) could be warranted because (1) the persons (2) were employed by or associated with a public enterprise (3) that engaged in or affected interstate commerce and that (4) the persons operated or managed the enterprise (5) through a “pattern” (6) of racketeering activity, and (7) the taxpayers were injured by reason of the “pattern” of racketeering activity.

<><> Alleged Offenses could include Violation of Rights – which prohibits in relevant part, “two or more persons (from conspiring) to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District

Oberlin’s cultural rot went far beyond SJW politics
into a culture of encouraging and aiding and betting student theft.

The college berated the bakery, claiming “Gibson bakery’s archaic chase-and-detain policy regarding suspected shoplifters was the catalyst for student protests."
The college defended student shoplfters saying, "the guilt or innocence of the students is irrelevant to both the
root cause of the protests and this litigation,” the college asserted.

CASE IN POINT The state of Georgia tried convicted and jailed 27 corrupt educators under this law.....

BACKSTORY The 1980 Georgia General Assembly was concerned about the increasing sophistication of various criminal elements on the public payroll (and those in elective and appointive office). the increasing sophistication of various criminal elements on the public payroll (and those in elective and appointive office). The Georgia General Assembly then adopted the Racketeer Influenced and Corrupt Organizations Act (RICO), patterned after a similar federal law. (RICO is routinely used to try to prove that a legal business was being used for illegal means, and, in at its inception, RICO was used to prosecute drug traffickers or organized crime members).

In recent years prosecutors have applied RICO to crooked government officials: (1) those accused of using their public offices for personal gain, and, (2) tax-paid officials of govt agencies using public monies to flout the law. To bring a case under Georgias RICO law, there must be at least two underlying felonies such as fraud, bribery, witness tampering (among other felonies). RICO allows prosecutors to include multiple defendants charged with various crimes in the blanket indictment, and to charge that govt employees, publicy-funded and publicly-sanctioned entities were allegedly part of an ongoing criminal enterprise.

EXAMPLE A govt official commits two felonies by (1) accepting, and, (2) filing falsified documents.

ITEM---Any public official using tax dollars to flout that law is a lawbreaker.

ITEM-- in cases where govt officials on the public payroll not giving public notice is a violation at the federal level of the 1946 Administrative Procedure Act, which requires notice in the Federal Register. Laws demand that taxpayers have the opportunity to submit views in writing.

If proof is established that RICOed criminal public officials impaired the region's commercial and economic activity, that could also be prosecutable under the Hobbs Act.

Liberals have attempted to engineer a world for themselves in which they are free from consequences: abortion, homosexuality, pedophilia, depravity, drugs, alcohol, illegitimacy, overspending, etc.

They couch it in all manner of anodyne terminology: choice, pride, sexual freedom. If they can’t make it a positive, they attack anyone who disapproves as a prude, judgmental, a hater, etc.

Among the many problems they created for themselves was the parasite class.

These are people who aren’t all that interested in the high-minded talk - they just want their check. Or booze. Or drugs. The three ‘students’ were lab-perfect parasites. Violent ones.

The mass delusion has also resulted in the current state of affairs in which amoral people believe they are the most moral among us. They’ve gone from ‘leave us alone’ to ‘we won’t leave you alone.’ (hat tip relictele)

Liz, that's a mighty powerful indictment of Liberals.  Worth saving.

Thank God we've got folks like Judge Jeanine and Tom Fitton fighting for us.  Congressmen?  Mostly worthless.  If there's anything we've seen in the last two years: reform of our government doesn't just happen.  A concerned citizenry and an honest, lawful man at the top can do wonders.  But it's still a long haul.

And HarleyLady27, I found a great story (November 2016) shortly after the Oberlin student protests began.

Shows how the community stood up to the social justice idiots and brought some business to Gibson's.

Seems some BIKERS paid a visit, too. . .

Gee, where did those protesting students go?  Bwahaha!  Some mean looking bikers in that store! MAGA! Bikers for Trump!

Oberlin is apparently also being sued in federal court in a case where her actions are at issue. She won’t be fired until that case is resolved- if ever.
