LPD: Woman arrested for turning in husband’s firearms to Lakeland police

LAKELAND — A 32-year-old woman was arrested on June 15 when she gathered her husband’s guns to turn them over to the Lakeland Police Department.

According to Courtney Irby’s arrest affidavit, she told police her husband had been taken to jail for trying to run over her with a car. Irby said she went to Joseph Irby’s apartment on Village Center Drive in Lakeland and searched for the guns she knew he had.

When she told a Lakeland police officer she had the guns with her to turn them in, he replied, “So are you telling me that you committed an armed burglary?” and Irby answered, “Yes, I am, but he wasn’t going to turn them in, so I am doing it,” according to reports. Police verified Irby had never stayed at her husband’s apartment until the day of the burglary.

Maybe they can stay married and be assigned to the same cell in the same prison under Bella Pelosi’s goal to keep families together.

No, she was arrested for burglary. She stole his guns. By arming herself while committing the burglary she committed aggravated burglary.

She was not arrested for “turning in her husband’s guns”.

I saw this story last week. She did what she had to do for survival.

Oh, my aunt Fred!

First, if somebody attempts to run you over with a car, you file a report with the police and have them arrested immediately.

Second, you simultaneously file a restraining order and as soon as the police report and restraining order are submitted, the police serve the defendent, search their property/premises and then seize their fire arms. Qnd heaven forbid the police find unregistered / illegal firearms, that knucklehead will not see the light of day until he/she proves their innocence.

Problem solved.

She’s an hysterical, wannabe victim.

Lee, come on! You don’t commit a felony to get even with your ex-husband!
All she had to do is tell the cops she was fearful of him, and that he owned some guns, end of story! if there’s one thing most cops love to do is confiscate weapons.

Go read Reddit’s r/entitledparents and come back and tell us that. Sorry, entirely too many entitled people claiming someone tried to run them over when a rational person and a camera would find otherwise.

If she really had been so attacked, she would have filed charges with the police. She didn’t.

marital property in Florida includes all assets and debts either spouse acquires during the marriage....

In Texas we call this Joint Property, so I would argue she did not ‘break into’ her apartment.

She broke in to his apartment not their apartment. She apparently had never even stayed there.

Except that Florida is a free state - there is no registration of guns.

People are free to buy, own and sell legal guns within the state without any involvement of the state government.

The only exceptions are for criminals who have lost the right to own guns.

And you have proof positive that he bought the subject firearms during the marriage and that he did not own any of them prior to the marriage?

I’ve seen this story a couple times. The husband was literally in jail on domestic abuse charges for trying to run her over. That’s why she knew she was safe to take the guns.

If the police were doing their jobs, he wouldn’t have had the guns any longer.

I guess she is probably happier to have been arrested than to have wound up dead.

Good on her! She didn’t stay with an abuser. She tried the legal route and he still tried to harm her, so she took matters in her own hands. She stood up for herself. It stinks that it had to go this way but at least we aren’t reading about police finding her body in a dumpster.

Nope, just a thought. Of course the Police should have accepted the action. It is like when a criminal becomes a CI, the Police over look certain activities.

You do know that the whole ‘florida man’ thing is based upon FL’s public records law right? Journalists everywhere can do daily searches of FL county arrest records trolling for interesting arrests. That and beach weather 9 months a year is fodder for the MSM trolls.

Then he became the exception in January when she got the first restraining order.

The “armed robbery” charge was based on the guns she took, not because she was carrying one when she went to take the gun.

What else was she supposed to do? She got away from him, filed for divorce, got restraining orders, he still attacked her, with his car, leaving a court hearing. She knew he was in jail. She knew the police weren’t doing their job, and she knew he had tried to kill her before.

IOW, because you are a gun owner, you get no due process as regards your property.
