Breaking: Trump Hits Dems with Census Curveball, Announces Plan To Circumvent SCOTUS

President Donald Trump announced Thursday he’ll be issuing an executive order directing federal agencies to provide the Commerce Department with records pertaining to “the number of citizens and noncitizens in our country.” Speaking to reporters from the White House Rose Garden, Trump said his administration is “not backing down on our effort to determine the citizenship status of the United States population.” While Attorney General William Barr said the citizenship question would not be included on the 2020 census, Trump detailed what his administration will do instead.

“I am hereby ordering every department and agency in the federal government to provide the Department of Commerce with all requested records regarding the number of citizens and noncitizens in our country,” Trump said, as ABC News reported. “They must furnish all legally accessible records in their possession immediately. We will utilize these vast federal databases to gain a full, complete, and accurate count of the noncitizen population.”

I have no doubt that is true and I also have no doubt that the ultimate goal of the left was to rip citizenship from real citizens. The Revolutionaries have a long term plan to steal our nation from under us.

I and my girlfriend were talking about this the other night. Suppose he gets re-elected, then what in 2024? I have no opinion of Pence, but as I understand it he is a good man. BUT, that means very little if he does not have the gravitas or, quite frankly, balls to operate the way DJT does-to do the things that are needed to continue on this path of saving and restoring the Republic. I just don’t see that in him. Hopefully DJT is re-elected in 2020 and a true successor emerges before 2024.

there are 2 components to the ilegal immigration issue..the private side is that in every community, a certain number and type of industry is dependent for their profits on the “undocumented worker” (as they put it)

By the same token, in those community’s, a certain number and type of local, state and federal bureaucracy has grown over the decades to ‘”support the needs of such “undocumented workers”’.

Both -the industries, and the bureaucrats exploit the undocumented to their own ends. Those ends are met by facilitating the “undocumented worker” into the voting booths -BUT NOT INTO THE SYSTEM which would negate their “utility”

He knew all along that a 10 year “census” (with coaching on how to lie) would be useless - they played right into his hands...might end up draining a few swamp critters from some of these agencies while he’s at it.

there’s going to be a HUGE number of illegal immigrants uncovered and the wailing and gnashing of teeth will be bipartisan- represented by the employers (Red) and the service bureaucrats (Blue) whose existence is threatened by truth.

No, I got it. I agree about the Constitution being null and void, but that has been true for a long time. It is a living document, after all. But I have to laugh at all the big talk about shooting war. Easy to write, isn’t it? A little harder to put in practice. It seems to be a habit on this web site.

Exactly, that is why this is a lose instead of a win. Of course just about everyone else on FR think this is a huge win or are to scared to state the facts against the masses.

PDJT should be continuing the fight to get the question on the census.

Doesn't ICE at least keep track of the names of those who have been "caught and released" into the general population?

Not ICE but DHS are the keeper of the data, mostly. Combining all of these will give us a good count of illegals in country that have been caught. Now for the 90% that slip through the net, extrapolate.

All that really matters is California. Another sanctuary state or two will ne nice.

When records of non citizens in California are collected, the California presidential and senate and even the House elections can be thrown out. The records are proof of a sizeable body of non citizens that have been provided credentials that allow the non citizens to vote. Since there is no way to know the precise number, the entire election must be thrown out.

California is no longer really America having become a sanctuary and thus left the union

That is except for nonfederal offices such as Governor or State Senate.

You are quite wrong on this point. The Apportionment is based on the numbers of persons as enumerated by the Census. That is by law and by the Constitution. The states will determine the boundaries of each district but they must be equal in number to all districts in a state to the maximum extent possible. Everyone, citizens, green visa holders, illegal aliens, inmates, lunatics, etc. etc. count if they were counted in the enumeration. This is one of the reasons that the Democrats have been fighting this issue.

Not enough! The census is what is used to determine representation as well as electoral vote power. It would be great to know actual counts, but knowing is only half the goal.


There is a lot of things in play here. With all this publicity, many illegal imigrants are not going to want to be noticed and fill out a form. The rats will make an issue of getting them to fill out the form. Trump will make an issue of what the rats are doing.

Evidence would suggest that Trump will groom his successor. Now is not the time for that.

This still won't work for the census. Next time around John Roberts will side with the liberal wing to rule that considering citizens vs non-citizens in the count is not permitted. He won't take kindly to Trump trying to get around his last ruling.

Actually The Supreme Court ruled that illegals can be counted, not that they must be counted. “See the April 2016 Texas redistricting ruling”. There’s nothing etched in stone in the Constitution that states illegals must be counted, in reality that’s at the discretion of the Secretary of commerce. Quoting written law- “a) The Secretary shall, in the year 1980 and every 10 years thereafter, take a decennial census of population as of the first day of April of such year, which date shall be known as the “decennial census date”, in such form and content as he may determine, including the use of sampling procedures and special surveys.”

It should be noted that vacationing non-citizen visitors to the U.S. are not counted, so there’s nothing that mandates all categories of people on US. soil be counted, the only people who are likely mandated to be counted are those with 14th amendment citizenship protections and perhaps legal non citizens.

See post #89. Unfortunately it is settled law. Post 89 direct from the Census website states plainly that illegal aliens are counted in the population and included in the House apportionment.

It is the result of a Supreme Court case a decade or so ago and the SC ruled illegals will be included in the Census and included in the House apportionment. I fully understand all the arguments against it, but they are mute from a practical point of view. It is not just an administrative decision, it is the law.

The question Trump wanted was for informational purposes. The Dems feared that some illegals would not participate in fear, but there was never a question to include them or not include them in the population count and apportionment.

The April 2016 count has no relation to the original SC case and is meaningless to the apportionment process. The original case is very operative. Nothing has changed.

Roberts said Ross wasn’t ‘clear’.

Roberts said Ross had the power to include the citizenship question. In other words, there is no law against it.

But Roberts passed it back to lower courts because Ross ‘failed to give a good argument’ using the VRA and needed to provide better reasoning. In other words, Roberts punted but he didn’t need to. He said clearly Commerce has the power to ask the question.

Roberts decided to play politics.

He knew full well that kicking it back downstairs would cause delays, enough to keep it off the 2020 Census. Roberts was said by prominent Americans to just want to ‘stick it in the eye’ of Trump. What an ass this guy is. He’ll get what’s coming to him when RBG croaks.

But Trump is smarter and faster than Roberts. He dug into the weeds with his Commerce Directors and their advisory panels. He saw immediately that the Apportionment Population is estimable using tested and seasoned methodology backed by verification methods using federal databases.

And Pelosi can do nothing about it because there is no law restricting it.

We can expect some snits from Pelosi’s progressive base to file suit against using mathematical estimation methods which have been used for more than a hundred years. Such a suit would upend the history of the Census. Trump’s lawyers could fight that insanity while allowing Commerce to continue.

In other words, a nuisance lawsuit can’t be allowed to stop the Executive Branch from performing what it has done for more than a hundred years. In such a case, the courts would need to make a new law which they won’t and can’t do The basis of such a nuisance lawsuit would be that Census estimating procedures are discriminatory but there can be no facts to support that. Bringing such a lawsuit at the last minute without factual history would tie up the court’s time but wouldn’t stop the 2020 Census from proceeding.

Trump wins and we win because the groups using illegals to thwart our established conventions are defeated. If Republicans retake the House and hold the Senate, a law can be passed that makes the purposes of the Census clear and meaningful.

The history of the US Constitution addressing the apportionment of representation in Congress is the original Constitution and added provisions called out in the 12th and 14th Amendments. It is clear that Americans born on its soil including Native American Indians who pay taxes, freed slaves, all that have constitutional voting rights (felons omitted), are entitled to have representation in Congress.

The Census and its policies and procedures have always until 2010 under Obama been guided by good and common sense using tested and seasoned methodology.

It wasn’t until 2010 and now 2020 that the leftists are pushing an oblique power grab to stop the American government from counting its citizens.
