For the second time, a judge threw out all charges Tuesday against an Amtrak engineer for his role in a high-speed derailment in Philadelphia that killed 8 people, saying: "The law recognizes we're all human."

There is something very fishy about this.

“We are all human” my A$$.

If he was not in a protected class (in this case: Gay), he would be in prison. Bank on it.

IIRC the engineer is a member of a protected class.

Or computerization which he couldn’t override (as we have seen recently with Boing) and of which he was unaware caused the speed. And the judge wasn’t on board with trying to make the engineer take the fall, yet also wasn’t willing to reveal what happened to the public.

Sound like a bad movie plot? So did the Boing 370 fiasco until it kept repeating itself.

The second time? How many times did this guy have to stand trial for this incident?

"The law recognizes we're all human."

He might as well have said like the Judge said of the teen rapist, that the engineer "came from a good family."

If he was not in a protected class...

Is he a protected class?

He was not found to have been under the influence of drugs and was not on a cell phone. He was distracted but company communications regarding rocks being thrown at another train in the area according to the article.

Do you know something different other than it was an honest mistake/job failure with tragic consequence that rises to the level of crimal?

If it was computer error, I think it would have been blamed on that. They certainly don’t seem to be covering it up in the Boeing case, where the stakes and loss of life were much greater.

I’ve never heard of someone just skating like this when it was human error and fatalities were involved.

I believe I read it on FR a few years back that a different example of a gay lover commuter train engineer was jilted and hysterically decided to kill everyone on board and himself in a train crash. Can’t find a reference.

Maybe I’m mistaken.

Is he a protected class? Yes: he is gay.

He was distracted but company communications regarding rocks being thrown at another train in the area according to the article. Horse $h!t. A train operator should be able to do multiple things at the same time, especially if its listening to the radio and driving the train.

An outright lie is even worse than a lie of omission, RGB81.

Let me correct your statement.
They aren't lying about Boing 370s ANYMORE.

The first one they were indeed trying to pass off a pilot error. Until that became untenable.

What if a commercial airline pilot said he couldn’t fly the plane while talking on the radio? Gimme a break.

A valid point, but this seems a lot more cut and dry than the Boeing case (which they are still looking into and may even be attributed to the basic plane design).

And what exactly leads you to believe this is due to computer error?

We’re all human? Well then I guess charges against Charles Manson should have been dropped too.

I really haven’t followed this one.
But it was pointed out that the decision is very dicey, and that generally means that there are factors which the prosecution and the judge don’t want to admit.

Which we saw with the Waco massacre.

I don’t think his being ‘gay’ had a lot to do with it.

I would look at his relatives and see who is a big name...................

Zero. It never made it to trial as far as I can tell.
