It doesn’t make sense to prosecute him for leaking a document that was not “classified” at the time he leaked it. The DOJ classified afterwards.

So, if they wanted to prosecute it would look as though they created an x-post-facto classification simply to prosecute him. That is kangaroo court crap—and any judge with any sense would toss it out on its behind.

There will be plenty to “get him” on in the coming months. I think its best not to start out with a loser of a case.

DOJ was formed in 1870 which makes it 149 years old, not “over 200 years” but hey, what do I know. It’s not like I’m a journalist or something.

Very interesting. I said the same thing as soon as the news of the decision not to prosecute Comey over this came out the other day.

Just a couple of important considerations:

1. Comey could only be prosecuted for leaking classified information to the media if the information he leaked was TRUE. The problem in this case is that proving that the information in his memos was true would likely require testimony from President Trump. That's never going to happen.

2. There's a legitimate question about whether those stupid self-directed memos were even official FBI documents anyway -- regardless of whether they're true or not. Comey didn't prepare them on behalf of his superiors, and wrote them to himself and gave them to the media apparently without sharing them with anyone internally at the DOJ.

They’ve probably only scratched the surface of Comey’s corruption. Look at all the corrupt scoundrels Obama put in place.

Obama and his goons need to be tried and convicted then dealt with accordingly.

AS I said before, I will believe it when I see it. Until proven different, I still maintain that there are at least two systems of justice. One for the peons and Republicans and one for the Elite Democrats. The time for talking is past. Now comes the demonstration.

I would already be in prison if I had leaked classified government documents to the media. Just like the Navy guy who took pictures in his submarine? I am sure he had no intent to sell them to the Chinese. He just wanted to show his wife & kids where he worked. He went to prison.

I like Joe and his wife Victoria but they are WAY to fond of Bob Barr and feel he can do no wrong.

It is not about being vindictive. It is about fairness. It is about not having a 2-tiered justice system where poor black people go to ass pounding prison for having an ounce of crack but Hollywood starlets get off with warnings after being caught with powder cocaine multiple times.

I am livid about this. DiGenova is dead wrong. There is no reason they DOJ could not have waited until the investigation ran its course to decide whether or not to prosecute. Coming out the same day to say “Comey gets off start free” smacks of more biased corruption by the DOJ letting FBI people off scott free.

I am furious. This is BS BS BS BS BS BS!

This case seemed pretty weak but are there actually any signs that anyone anywhere is conducting a criminal investigation? Ya know juries empanaled, warrents issued, people compelled to testify etc.
