Senate Dems deliver stunning warning to Supreme Court: ‘Heal’ or face restructuring

Several high-profile Senate Democrats warned the Supreme Court in pointed terms this week that it could face a fundamental restructuring if justices do not take steps to "heal" the court in the near future.

The ominous and unusual warning was delivered as part of a brief filed Monday in a case related to a New York City gun law. Sens. Sheldon Whitehouse, D-R.I., Richard Blumenthal, D-Conn., Mazie Hirono, D-Hawaii, Richard Durbin, D-Ill., and Kirsten Gillibrand, D-N.Y., referenced rulings by the court's conservative majority in claiming it is suffering from some sort of affliction which must be remedied.

"The Supreme Court is not well. And the people know it," the brief said. "Perhaps the Court can heal itself before the public demands it be 'restructured in order to reduce the influence of politics.'"

The last part was quoting language from a Quinnipiac University poll, in which 51 percent favored such restructuring. In the same poll, 55 percent believed the Supreme Court was "motivated by politics" more than by the law.

Dramatic changes to the Supreme Court have been proposed by several Democrats vying for their party's 2020 presidential nomination, with "court-packing" being a common -- though highly controversial -- suggestion. Increasing the number of justices on the court would allow the president to shift the balance on the bench by loading up justices of his or her preference.

Congress has no power over the Supreme Court, but they do have control over the creation and jurisdictions of ALL inferior Federal courts. Right there in the Constitution. Which Demonrats no longer read, except to have something to beat us over the head with, or some way to wiggle out of its strictures.

It is Congress which sets the number of justices. What I want to know is, why is Roberts still Chief Justice? Their terms are appointed by the President, and are to expire when he leaves office.

The reason they always want higher minimum wages isn’t just to offer free stuff for votes, it is to motivate business people to press even harder for cheap labor... they know full well how bad it is for the economy, that’s why they like to do it when there’s a GOP president.

do they even have a legal argument? It seems their argument is “The SC doesn’t vote exactly as we like, therefore we demand it be changed” and to ‘support’ this non argument, they say “The court is sick and everyone knows it” Without providing any actual proof that ‘Everyone” thinks it

Even more, it’ll be the go-code for the entire world to come off the leash and settle old scores amongst themselves, not to mention the economic collapse that would also follow in virtually every nation that either holds our debt or takes our handouts. Article III

Section 1.

The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office.

Section 2.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects. In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.

The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed; but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed.

Section 3.

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted.

I wonder want law this is. Restricting magazine size and ordering that common 10 round magazines may only be filled to seven has been fashionable for Northeast liberals. If one of these laws is stricken they all fall.

Quinnipiac isn’t a reliable pollster (not that any of them are) and shouldn’t be cited as showing support for anything. They are Rat push polls.

Their final Florida polls in 2018 had Nelson and Gillium both winning by 7.

That completely discredits them forever. They should never be cited for anything again.
