Considerations from Shooting in Kam’s Market, Bay Point, California, 2019 ~ VIDEO

An attempted armed robbery and self-defense shooting occurred in Kam's Market in Bay Point, California.  Bay Point is in Contra Costa County in the East San Francisco Bay area.

From multiple published accounts, Mark Kaspowitz was starting to close up for the night at about 11 p.m. on 22 December 2019.  Two masked assailants came into the store. One of them jumped the counter, confronted Mark, attacked him, and took money from the register. The assailant pistol-whipped Mark with what appeared to be a semi-automatic pistol, beating him down to the floor.

The assailant used both hands to grab the cash. From the floor, Mark manages to access a store owned pistol kept in a drawer not far from the cash register. The robber noticed and attacked Mark again.  Noticing Mark's access to the store pistol, the assailant recovers the pistol he brought to the store and again used it as a club. Mark fired a shot, pointing the store pistol upwards at the person who was above him and pistol-whipping him.

The robber fled the store, only to die outside, yards from the entrance.

Mark Kaspowitz is reported to be a military veteran of the Air force, from 1980 to 1984, with about 20 years experience as a security guard. He said he is 56 years old. After the shooting, Mark gave an interview to reporters in the video below.

Here are a few things to consider from Mark's experience.

Situational awareness:

Mark was busy with the store close down procedures. The store considers robbery a serious threat, or it would not have a store pistol available to employees. Closing time is a prime time for robbers.

NEVER give an interview to reporters. They are NOT your friends so do NOT be tempted. Say nothing. Not even “No Comment”. And when is property allowed to “own” a firearm?

All good points.

But we are trying to change that.

It used to be gunfight winners were hailed as heroes.

That needs to be reinstated. It is happening.

Pretty sure that just about every permit holder in the USA has seen yesterdays church shooting and realized that if the people who had detected the threat had, perhaps, sat directly behind the suspicious character with a hand on their holstered gun the perp might have been killed before he got a chance to kill anyone else. As of today we all have been put on notice. Up your game or loved ones die.

Ask “Tony Soprano” so to speak. 9/10’s of the law is possession— when used for defense, oh no- you can’t do that.

When in doubt, and even when not-— carry. Legally if possible.

Indeed it does. Like the folks in White Settlement yesterday. Few people “want” to take someones life but they did the right thing and I hope God comforts them in what they did. Which was the correct thing to do. Time to quit giving the perps the benefit of doubt and making them out to be the victims.

Excellent advice. The DA will be going over his remarks, looking for a reason to charge him. And the perp’s family lawyer will be doing the same, looking for a reason to sue him.

Good post, good shoot, great outcome.

Bay Point is FAMOUS in the SF Bay Area as being “the really bad area”.

That a night clerk THERE would not carry his pistol right near his hip is sort of amazing.

VERY many people there like to cause problems.

Much of Bay Point is Salvation Army, liquor stores, smoke shops and gun stores.

Most likely the clerk did not have a CCW. That is rare in the Bay Area. Having it in a drawer by the cash register is okay even in California. The clerk was seriously unaware to the point that he deserves a Darwin Award Honorable mention.

Not that it matters to the perp. Though it may matter to the accomplice, if caught. Why is this considered an “attempted armed robbery”? He took money at gunpoint. Heck, he even made it all the way out to the sidewalk.

Great video, great story, great reporting - you would not see that story reported that way in the DC area. Including a reference to the sign, “ robbers will be shot, survivors will be shot again.”
